I talked to Spike and Far-L this evening....tomorrow is a preliminary meeting of the attorneys and the new judge....no defendants allowed there.

Hopefully we will get to see what the researched for prior art and who they gave special sweetheart deals to, who has signed up and who gave out the mailing lists or am I hoping for too much?

Monday I will putting up a scheme where people can give something to the fight every month.

And yes support these guys who are carrying the fight for the rest of us. They need all the money they can get, because with US Justice it can be down to who spends the most.

Just got back from Europe and had an Acacia letter waiting for me, even tough the people I buy the streaming from have already settled. I guess they sold my name to the vultures, guess what is going to happen to them????

I had been trying to forget about Acacia but they just sent me another goddamn letter. I wish these people would just go away. I will dump every last one of the very FEW videos I do use on my sites before I pay them a nickle.

Unfortunately you are working under the assumption that all you need to do is remove the video and that will be the end of it. That is an incorrect assumption. The fact is that even if you remove the video from your site they will still make you pay for the time that you had the video on the site. According to the patent laws you have been infringing since the first day you put those videos on your site whether you knew about the patent or not. Accordingly you will be required to pay and if you've received more than one letter I'd say you are not going to be able to bury your head in the sand and hope this goes away.

Thanks to everyone for the support!

I must clarify that the IMPA is not actually going to court with Acacia and it is not be being sued or anything else. The Defense Group of companies that are actually being sued right now by Acacia are the ones actually going to court and fighting the case directlly. The IMPA can only help with research and community awareness.

As for today, I don't think much is going to happen that will be very earth shattering. The most important part of today is that it means that this this is finally getting on track to get before a judge. And that is good news in and of itself.

For a rousing speech though...

I would have to go with the "what wel do today will go down for an eternity/strength and honor speech from "Gladiator"..,

I'm curious, though. How do they know when someone puts the videos up? If you take them down, how can they even prove that they were ever there to begin with? They might be able to sobpoena your host to hand over server logs, but what if your host just doesn't have them?

And let's say someone put videos up, and they receive an Acacia packet a week later so they removed them. Would they be liable for the entire year or just the week that they were up?

Very little Acacia does makes sense. :(

exactly in some areas, how do they prove what you made from video and charge you accordingly. Non sense

I'd rather not answer the first question here in case they don't know how yet but there is a way that anyone can see what your site looked like throughout it's history.

Also, I'm assuming that the idea here would be to take the videos down at such time that Acacia notified you that you were infringing. Of course, by the time they've sent you notice they've also surely made a screen shot of your site as it was the day they looked at it. Even if you've only gotten their 'fishing' form letter you have no way of knowing whether they've actually seen and recorded your site yet or not.

If it was Matrix who's database was accessed then in most cases we listed at least one website on the form that we filled out. Even if it was CE or someone else, in most cases they ask you to list at least one website that you own so it's likely that even in the case of those who have only gotten the form letter so far that Acacia knows at least one of your websites.

Of course if you registered your website domains using your actual information they can look up one and find them all. Might be a good idea to go modify your whois info. :winkwink:

The meeting on Friday where the defendant's attorneys, the new judge and Acacia went better than how the article portrayed it.

Spike gave me the details on Friday evening, and the news is VERY, VERY good.

There is supposed to be some writeups on Monday, so I have been sworn to secrecy not to reveal any info.

So many people were asking me, so I figured i better post something here now...in anticipation of tomorrow.

I am ready to post my comments and commentary as soon as the official news is released.

Everyone seems to take the weekend off...for me, the internet never closes, so i have been waiting for what is a week in internet time for Monday to roll around to be able to share the news.

Acacia does not even bother to research who they are sending letters to, a few weeks back I recieved a letter that was sent c/o one of my corps that was dissolved back in like febuary of this year. So it just goes to show they are out to try to ass rape everyone.
