:mad Acacia Legal Activity (listing)

A list of court actions taken by Acacia... very interesting reading...if you can read the legalese, you can see who settled and who is fighting.

When clicking on this URL, choose California and press "select state", then in the 'company name' box, type Acacia and press search.

You can sorta decipher the legalese and read who has settled and who is still fighting... look at the last entry for a particular company to see the last status.

Their attorney probably watched one too many internet videos.... being so small on the screen and forcing him to sit 2" away from the monitor to get the same effect as his big screen TV.... and probably got used to that and wrote with small fonts.

Not necessarily.. I think there was at least one case in there that was moved to a different district *Lightspeed if i'm not mistaken*. I take termed as to mean it's no longer on this particular set of dockets for whatever reason. So, be careful I wouldn't want to say someone settled when they're actually slugging away but in a different venue.

Hey, FTP, do you have an ICQ I can reach you at? I'd like a quick way to contact you about prior art. I bought some old C64 and Amiga computer books on eBay and as soon as they arrive I'll (hopefully!) be needing to talk to you about my findings.

Some oversight by someone, but atleast you have it entered into the GFY record.

Lightspeed and the other 10 defendants are the true heroes, standing up to patent abuse for their business as well as for all webmasters.

I believe that is where the plantiff dropped the case.. could be because of a settlement or some kind of deal made.

Well, I thought that it had said your case had been moved to a different docket but didn't want to open it back up and look. I have a chronic case of laziness today but I also didn't want your name slung around any more than necessary. I think everyone needs to stick together on this that's taking a stand

Well, I thought that it had said your case had been moved to a different docket but didn't want to open it back up and look. I

A new judge was assigned to the case for all the pending cases... hopefully this new judge will get the cases scheduled so that the first defendant can go to bat.

What can I say, the last thing I told Rob Berman was "Lick My Balls" -- I'm dissapointed that is not in the record.

ya....and since acacia already claims that Lightspeed is infringing, it wouldn't hurt to add on another audio download with a sample of the conversation.

Steve Lightspeed: I would be careful about using that kind of language... imagine if you have to stand in front of the Judge and Jury and you are asked by Acacia's attorney... "Mr Lightspeed, for the record, did you in fact ask Mr. Berman to lick your balls?"

And because we are all about the truth, the whole truth and nothing but the truth... you of course would have to answer yes...

Then he might say something like "Well, Mr. Lightspeed, ball licking might be something that is acceptable on a daily basis in the world of PORNography.... but in the world outside of porn, ball licking is hardly considered a moral act unless it is between two married and consenting heterosexual people in the privacy of their own home... and even there it should only be happening every five yearsand only on anniversaries. In other words, Mr. Lightspeed, ball licking could hardly be considered a polite proposition or a model of decorum."

Perhaps it would have been better to say "Mr Berman, may I please ask if you would you be so kind as to titillate my scrotal sac with a gentle sucking action with your mouth encompassing both my gonads?"

on the holio case (first one i went to)

NOTICE OF MOTION AND MOTION by defendant Holio.Net LLC to
strike Immaterial, Impertinent, and Scandalous Matter from plaintiff's Complaint; Motion hearing set for 10:00
5/12/03 (tw) [Entry date 04/18/03]

so apparently acacia is immaterial, impertinent AND says scandalous things in their complaints and responses

yes of course! but actually, several records had the same comments.... the defendants were trying to put up some roadblocks about Acacia's tactics, and i guess the judge overruled...probably because they saw nothing wrong with the "marketing" materials or tactics used.

Since the message was sent thru my attorney, I'm sure he added a bunch of "therefore"s and "whosoever"'s and a bunch of other legalese for me. Fucking lawyers can't write hello in under 4 pages.
