Acacia workaround

I just came across a product called Clipstream that claims to be "Playerless Audio & Video Software". Among the claimed advantages, they list "playerless -- no downloads, no plug-ins".

If a subscriber accesses a video stream but does not download a file or display it in a client-based player, doesn't that bypass Acacia's bogus patent???

Besides, Acacias thing is that they have a patent of the technology of sending you a video in compressed format on demand. IE covering all bases..

But that's just the point. This Clipstream thing apparently does NOT send you compressed video. And if you are not receiving compressed video, (and if the server is not transmitting compressed video), then there can't be any patent infringement.

Are you actually listening to what you're saying?! You go try streaming an uncompressed video across the internet and lets see how far you get. it would be cheaper to pay them than try to send uncompressed video to thousands of people at the same time.

Now, lets just assume what you said is true, how would the video be shown if there is no plugin/client for playback? Something has to show the stream doesnt it?

Show me just 1 single site where you need NO client to play back the video. Even if it is Javabased, it would still be a client.

They dont need to fight many battles, all the need to do is actually make it stick to one guy. Granted other will indeed fight but look at the company, they're all lawyers!

It isnt like they have to actually do any homework to fight every battle since they're all the same based on the same thing!

Actually, it's java, not hahahahahahahahahaha. A patent lawyer could have a field day with this (and billable per hour), as it seems debatable whether the stream is fully controlled from the server or not. One thing is for sure --- there is no plug-in or executable client that needs to be downloaded, which makes it quite nebulous as to what is initiating and controlling the playback.

BUT --- after investigating further, it's a moot point, as it would appear as if the cost of licensing Clipstream isn't that much different from the cost of licensing the bogus DMT patent at the end of the day.

What's this world coming to? Ain't there a free lunch anywhere anymore???? LOL!

This is not a workaround.


One workaround is to have your audio or video in a loop much like net radio stations...and you can use whatever streaming server(ie. shoutcast, windows media) by creating a play list.

If the user can't select which item to download, then that gets around the patent claims....this is why Acacia hasn't targeted net radio...they tried with RadioIO back in october 2002, but i think they gave up when the realized it was a bad target.

Setup a schedule that shows what/when the next clips play....the user has to sit there and watch/listen until whatever is they wanted to see appears... but then again, they are watching...spending time on your site...so you can take advantage of that...

they could be viewing previews of things they may not have clicked on, but since it's in their face, its got their attention.


I believe this approach "extends" the patent (as if Yurt, the inventor of the acacia DMT patent, really invented downloadable audio/video) to make it one better.......

Because the audio/video is not able to be selectable, it becomes different than Acacia's patent claims.

Haven't gotten verification yet from a patent attorney, but I do believe this is a real workaround.

For those with audio files, you could shoutcast (http://www.shoutcast.com - free) and load up your MP3 in a playlist. For Windows Media (for video), i believe you create an .ASX script (haven't done this one before, but know you can link several videos together)

Acacia is not the end..it's the beginning for the adult industry to have to deal with a new threat that faces its business.. goverment action has been around for awhile, and it is picking up.

But now with patent infringement cases, patent holders like Acacia will be looking for new ways to "tax" businesses.

if the patent is valid...more power to any patent holder. If the patent has prior art and is not novel, it deserves to have all websites bring the smackdown on it.
