An Idea to Fight ACACIA...
Ok, I have no legal backgrounds or anything... but I thought of something... can anyone here tell me if this is the way things work?
ACACIA basically said they want to go after small people and get the money out of them.... they won't go after thebig companies such as microsoft or Real Player, etc.... right? Now, my question is this.... In the United States.... if you know someone is in infringement of something... I believe you are legally able to sue someone on behalf of someone else, correct? I know this might be far fetched.... but if you are able to do so, couldn't someone decide to sue Microsoft or msnbc or someone like that, who's got the legal power and money, on behalf of Acacia? That way, that person will loose in court.... setting a PRECEDENT for such a case... and then be able to use this precedent against ACACIA in court to overrun the pattent? no? Is this something possible, or not?

I doubt that would work.
Otherwise people could infringe on anything they wanted, have their friends sue them and lose, and be untouchable by the people who really have the cases.

I think suing Microsoft and Apple etc would be a great idea. Their licenses probably have a disclaimer about patents but the fact is that they market certain software as being fit for putting movies on the web. I think it would be fairly simple to convice a jury that their software is why Acacia is claiming you owe them money.

I am going to sue everyone:
(in no particular order) 1. WS_Ftp for their software that allows me to upload vids to the my server. 2. Redhat for the software on the server. 3. Compaq for the computer that allows me rip movies and upload them via ftp. 4. Earthlink for my dsl that allows me to upload the vids to web. 5. My surfers for coming to my website and buying memberships therefore forcing me to put videos on my website to make them bookmark. Who else? |
