Acacia Notices - AVOID the following sponsors...

Received one of those Acacia notices...it's informative and nothing more. It was sent via bulk mail; note the signature on the notice is a faux signature.

It's so obvious they just obtained a list of names from some sponsors to send notices to...my adult sites have NEVER contained any streaming media of any kind nor ever directly linked to any such content.

Surely they're not suggesting that standard HTML (ie. the A HREF link tag) itself is supposedly a patent violation too? Are they? If so then I guess the W3C group got a mountain of Acacia letters too :-?

Anyways, these are the following sponsors to AVOID ... one or more of them GAVE private information about webmasters to Acacia:

If you have an affiliate account with of the following sponsors consider canceling them since, according to the letter I received, they settled with Acacia - and one or more of them appears to have provided Acacia with private webmaster information:

Sponsors to AVOID:

* Hustler - not sure if they have an affiliate program anymore?

* IGallery / SmartBucks - doesn't appear they shared their affiliate list? But still...

* CE Cash / Cybererotica - read reports these folks shared their affiliate lists.

* Sexcheck AVS - owned by Dellwood Holdings...that company name seems awfully familiar...do they own any other sponsors?

* Platinum Bucks - may have shared their affiliate list?

On an aside, I'm curious whether webmasters who ultimately get sued by Acacia have any legal avenue against those sponsors that settled with Acacia and yet continue to run affiliate programs without disclosing Acacia patents; even those that have public disclosures, not sure that protects them if they allow affiliates to join without requiring them to sign a patent license agreement first with Acacia...

...My hunch tells me sponsors who settled with Acacia better hope none of their affiliate webmasters get sued...some of those webmasters may come back with legal action against the sponsors; or take other unrelated actions, since many adult sponsors are very vulnerable in numerous legal areas.

There are likely numerous other sponsors that have settled with Acacia and so it may not be practical for all webmasters to avoid all of them, but it's best to avoid as many of the above listed sponsors as possible - especially for new folks ... once you signup with any of the above listed sponsors, expect trouble!

hmmm, well since Hustler's agreement supposedly protects its affiliates, and since the notices I got cam before any affiliation with them, I have to say you don't know what you are talking about

Key word above is "supposedly" ... the only entity that can promise any such protection is Acacia itself...

Unless Acacia itself has indicated in *writing* that all of Hustler's affiliates are licensed to use their patents in regards to linking/promoting Hustler content and services, you should assume you're not protected in any way - perhaps even less!

it's muy muy important to realize that you only know about 10% of the licensees. According to dingleberry or chip or whatever his name was on the Q3 phone conference, when "Chris Roberts" asked him who had signed he indicated that most had required confidentiality agreements as part of the license.

Thus. You'll never know whether the ones you *think* ratted on you are the ones who really did, and you'll never know who signed and who didnt.

Isnt' this a bitch???

Getting a bit scared that what I posted is true...did PornDollar just settle with Acacia too? Sure seems like it from the way you post...

As to who I am...I'm a webmaster who doesn't like dealing with BS any more than most others here...

But for the benefit of the doubt I'm wrong, please indicate specifically in what way(s)...keeping in mind the following facts:

1. the letter is real and was sent to numerous webmasters
2. the sponsors I've listed are all indicated within the letter as to settling with Acacia
3. all webmasters who have used such programs face a real potential legal risk

Please feel free to correct me on any of the above items :-)

1. I havent seen any letter.

2. So you did some reading and found out some names.. By asking if Dellwood Holdings runs any affilate programs and your name is "Ron Bennett" automaticly tells me your full of shit.

3. Any sponsor that wants to be business will not sell / release any webmaster information. (unless it for illegal kiddie type)

You bet I did some reading...wasn't that difficult to name sponsors since they're mentioned RIGHT IN THE LETTER as well as some in various related news stories.

Yes for the most part, normally...however, one or more of the sponsors may have, as part of their settlement with Acacia, provided Acacia with webmaster information. There's another thread here where folks are trying to track it down, though to be honest, we may never know for sure what sponsors released the data; perhaps it was "leaked"...who knows. But it doesn't hurt to at least research the issue to see if the answer can be found.

Arguing among ourselves isn't going to help anyone...what is your view on the Acacia situation? -and do you have any good suggestions for webmasters affected?

My issue with you is that you come to a very public forum completely under the radar and state "Don't do businesses with these sponsors" Just as much as someone coming on and saying "This person shaves"

I have a pretty precise list of all affiliate programs I signed up for. TCG, Flynt and CE cash are on that list and I have not received a packet yet. I know that one person doesn't hold much merit but if I did get a letter it would be easier to narrow things down.

Keep in mind these affiliate databases could have been handed over by a disgruntled employee who has access as well. All without the knowledge of the company.

Just slinging names around is crazy at this point.

Well.. out of all that he said, there was one interesting point made..

If affiliates with these, or any other sponsors, are going to be subject to Acacia's patent license, then it should be the responsibilty of the sponsor to inform affiliates that such a license will be required in order to promote their program.

At this point, with everything that Acacia is claiming, things have to be looked at in a, "just what if" manner..

Ain't nobody gonna know nothin' for sure til the judge's gavel falls..
