Acacia Letter Update - 10/23/2003 8:58Pm EST

I have seen several post from Matrix content on this board claiming that they did not divulge their customer database. Now hear this.

I got off the phone with Acacia a little while ago, they told me that I was infringing on their patent with 2 of my websites, one of the two domain names does not belong to me anymore, I let it drop and did not renew it, the other one is a plain TGP.

1st point: Those are the exact 2 domains that I listed on Matrix content as licence's domains.

2nd point: Acacia told me that even if you link to a sponsor, and even if that sponsor has paid the licence fee; YOU HAVE TO PAY ACACIA AS WELL!!! If you link to a sponsor that has not settled with them, then they told me that they will sue you for, hear this: "PATENT INFRINGEMENT FACILITATION"

I think that the sponsors and content providers that are providing affiliate information are really shooting themselves in the foot. They will loose all the trust of the webmaster community and ultimately, will loose most of their business.

if the sponsor has already paid their 2% they cannot get another 2% from some one working there, that is a total of 4% not 2% and im sure if alot of sponsors knew all of their affiliates would be fucked with they would defend them?, because they are basically the boss of a business, but who knows

That is what comes to my mind, but this is America, if someone sues you. then you must defend yourself. For anyboy that has an iota of intelligence and technical knowlege, this Acacia patent bullshit is frivolous and outrageaous, but how do you know that the judge that will hear you knows anything about this kind of matter??? A damn patent & technology firm charges an arm and a leg to represent you, so they're betting on the fact that most people will pay to not be bothered. What's next? The patent on hyperlink?

Didn't Hustler and Vivid say in their joint statement that anyone who promotes them is safe from Acacia?

That's what I was going to say. Someone with a patent on hyperlinks was thinking of sueing everybody with a website and lost in the first court case.

Exactly. Everyone I have talked to is pointing their fingers at Matrix Content. Of course, they deny it and call me a liar but why would they let the cat out of the bag? That's bad business on their end.
