I talked to a webmaster yesterday that told me that she talked to Berman on the phone and that he got very irate while explaining to her that she should have to pay 2% of her gross sales, which is based almost exclusively on pictures and sales of panties and bras, regardless of how much video was on her site.
All the big folks that settled thus far... they got sweet heart deals... Acacia will not, in fact they cannot, beat these deals and now their confidence is at an all time high and they are asking steeper gross percentage numbers.
In keeping with their slash and burn method of licensing, they are still content to not explain in detail how anyone is possibly infringing their patent in favor of threatening devasting legal action.
Many other companies besides Homegrown are in the "eye of the hurricane" here...Video Secrets, Gamelink, Lightspeed, Top Bucks, AEBN, Ademia, Audio Communications, ARS, and more... These are the companies spending serious cash to fight this and putting more than just their integrity on the line.
We intend to win this thing and prove that no one should be paying that license. Acacia wants to take 150 to 200 million out of our industry. From my business perspective, and from my freedom of speech, I say that it is well worth it to challenge their claim and make them accountable.
We look forward to our day in court.
