Squirtit, I understand your point, but finger pointing can be harmful and dangerous if it's done irresponsibly. It's one thing to say "It's possible that Hustler did it because they were one of the companies who settled". It's totally different to say that we DID do it with no facts, no proof...just assumptions. Fletch XXX made that assumption last night, but we resolved our dispute very quickly because he was smart enough to double check his facts and then had the balls to apologize after he found out that things didn't add up. I didn't threaten to sue anyone. I just asked for an apology and a retraction unless he could prove his accusations (which I know he can't because I personally have control over the affiliate databases of Hustler and Vivid). This is a hot issue for everyone involved and I would be beyond pissed if someone shared my personal or company info with another company, so I understand why everyone is so hot. However, we have a long history of being honest and treating our affiliates well, so I don't like being accused of something that is totally false. |
Ken, didn't Hustler and Vivid say in their joint statement that anyone who promotes them is safe from Acacia?

Go away. Or why don't you go patent that revolutionary concept you claimed you guys came up with- raising webmaster payouts!! |
Quote:
at the rate they are mass snail mail spamming everyone and their dog how can they keep track of whats what anymore? Seems like a big scam, and whats worse is they are fucking up large in a few ways |

Wow, Holly. My suggestion would be to take a step back and breathe. I've known Ken for years, as a matter of fact without him I wouldn't be here today. And that post is out of line. |
Ken, Acacia is saying that even if you promote a sponsor that has settled with them, you will still need to pay fees.
This seems to be contrary to what you said in the Hustler/Vivid statement. Quote:

It could mean that Hustler/Vivid licence includes a blanket coverage for all affiliates. The 2% Acacia tax is backed out of Hustler's back-end. |

Ken has always been honest, and straight forward since day one. |
i'm inclined to believe ken.
there IS a rat but it's not ken.... I'm leaning towards matrix........ |

Not even worth responding to. Lens should charge you a fee for the space you just wasted on his board.... |
i was under the impression that hustler made a special deal in order to include its affiliates in their license.
and it's easy enough to figure out who is using hustler as their sponsor by looking at the link. if it links to hustler, viola! |

Of course there is a rat but I checked my mailbox and received no letter, and I am signed up with matrix and a few others on the list. :) |

[B] Holly, sounds like you have an axe to grind that has nothing to do with Acacia. You trying to push some kind of agenda? ------------------------------------------------------------------------------ Mike....I was thinking the same thing. Wonder who Holly is and why she's such a hater? ;) |
Hellooooooooo Ken? I had a question!
Answer? |

Ya know what I'm tired of? Patiently watching my sexy man answer Acacia posts while snuggling my cat. Can he please take a break for a bit? I need to occupy his time for about... uhm... two minutes or so ;) http://boobiebucks.com/cat/kittyken.jpg |
Kimmy, Sleazy, MikeAI,
Thanks for the words of support. I appreciate it! |
KEN, I POSTED A QUESTION

BRISK, Sorry....trying to do too many things at once. For the traffic you send to Hustler or Vivid you are NOT infringing their patent. For traffic you are sending to sponsors who have not settled, you might be infringing their patent. |

But her post clarified things! :1orglaugh |

You might want to phone Acacia and ask yourself (just don't tell them who you work for), see what they tell you. |

BRISK, We actually helped LFP and Vivid negotiate the settlement agreements and I've spoken with Rob Berman on several occasions to clarify certain issues. This was one of those issues. He told me and our contract states that our affiliates will NOT be held liable for contributing to patent infringement for the traffic they send to us. Now, if we have an affiliate who is also sending traffic elsewhere, they could be infringing with that traffic and they could be liable for the revenue associated with that traffic. |

I feel left out. :( Guess, respecting your wishes to leave the companies names that you represent (which were posted on the list) and mentioning another company is not the proper way of supporting you. Oh well, :) |
Not that I'm pointing any fingers here but I used to be an affiliate of a program called Matrix Bucks that doesn't exist anymore.

SureFire, Sorry.....missed that. .........thank you too! :) |

I'm sorry if I sounded harsh, but demanding apologies from webmasters right now seems ridiculous to me. I also know Giorgio isn't the only one who came to the same conclusions. I had two people yesterday swear to me that their info matched with Hustler. "Finger pointing" isn't nearly as stressful as what some smaller webmasters are facing right now. I'm sure it's just a drop in the bucket for you, but for some of us if this plays out the way Acacia is hoping it will, it's going to be a nightmare. I have no clue if your company is involved. But even if you're not, at least for the next few days until everyone gets through opening their surprises why not leave it be, or just state that it's definitely not you? I doubt you'll have many people lined up to issue you, or any of the other names in those letters, apologies until this latest round settles. A lot of people are scrambling for answers right now, which makes it even more infuriating when people claim they know where it's coming from, but won't tell. However, I'll be happy to tell I'm sorry for telling you to stfu. That was rude and unnecessary. I'm not in the best of moods about this today. If you still want to answer a question from me then tell me this- Do you have any idea who's releasing our info? OR- Do you know but for whatever reason you can't say? |

Holly, The only thing that bothered me is someone stating it as if were fact. If someone suspected that it was us, that's fine. However, if someone flat out accused you of something that was not true, you would be upset too. It's not a matter of money, but rather principle. That being said, thank you for apologizing. To answer your questions. No, I have no idea who, if anyone is releasing info. The first I heard of it was right here on GFY. If someone is giving up affiliate information, they SHOULD be boycotted by affiliates forever. I think we can all agree on that. I'm off to dinner with my sweetie.....she's been very patient! But I'll be back in a while to answer any other questions, etc |
