I understand your point, but finger pointing can be harmful and dangerous if it's done irresponsibly. It's one thing to say "It's possible that Hustler did it because they were one of the companies who settled". It's totally different to say that we DID do it with no facts, no proof...just assumptions.

Fletch XXX made that assumption last night, but we resolved our dispute very quickly because he was smart enough to double check his facts and then had the balls to apologize after he found out that things didn't add up.

I didn't threaten to sue anyone. I just asked for an apology and a retraction unless he could prove his accusations (which I know he can't because I personally have control over the affiliate databases of Hustler and Vivid).

This is a hot issue for everyone involved and I would be beyond pissed if someone shared my personal or company info with another company, so I understand why everyone is so hot.

However, we have a long history of being honest and treating our affiliates well, so I don't like being accused of something that is totally false.

Ken, Acacia is saying that even if you promote a sponsor that has settled with them, you will still need to pay fees.

This seems to be contrary to what you said in the Hustler/Vivid statement.

If that is true, how does Acacia know who to protect without a list?

It could mean that Hustler/Vivid licence includes a blanket coverage for all affiliates. The 2% Acacia tax is backed out of Hustler's back-end.

i was under the impression that hustler made a special deal in order to include its affiliates in their license.

and it's easy enough to figure out who is using hustler as their sponsor by looking at the link. if it links to hustler, viola!

Sorry....trying to do too many things at once.

For the traffic you send to Hustler or Vivid you are NOT infringing their patent. For traffic you are sending to sponsors who have not settled, you might be infringing their patent.

Acacia seems to have a different opinion when you phone them. I didn't specifically mention FlyntDigital or Vivid, but they said even if I send traffic to a sponsor that has settled I am required to pay them fees.

You might want to phone Acacia and ask yourself (just don't tell them who you work for), see what they tell you.

We actually helped LFP and Vivid negotiate the settlement agreements and I've spoken with Rob Berman on several occasions to clarify certain issues. This was one of those issues.

He told me and our contract states that our affiliates will NOT be held liable for contributing to patent infringement for the traffic they send to us.

Now, if we have an affiliate who is also sending traffic elsewhere, they could be infringing with that traffic and they could be liable for the revenue associated with that traffic.

You know your company is going to come under fire when webmasters names/info are being given out by someone, and you're one of the ones listed in the letters everyone are getting. The only thing that bothered me is someone stating it as if were fact. If someone suspected that it was us, that's fine. However, if someone flat out accused you of something that was not true, you would be upset too. It's not a matter of money, but rather principle.

No, I have no idea who, if anyone is releasing info. The first I heard of it was right here on GFY.

If someone is giving up affiliate information, they SHOULD be boycotted by affiliates forever. I think we can all agree on that.
