I dont believe Scores Cash shut down because of acacia because they did settle.

But what the hell happened? I mean shutting down an entire program without reason.

In September 2003, the Acacia Technologies group caused 42 websites owned by Go Entertainment, Inc. to be closed down. The websites were continuing to utilize Acacia Technologies group's DMT technology in violation of a court order. The U.S. District Court for the Central District of California issued an injunction prohibiting Go Entertainment from continuing to use Acacia Technologies group's DMT technology without a license. The Acacia Technologies group successfully enforced the injunction against Go Entertainment's web hosting company.
On September 22, 2003, the Acacia Technologies group entered into a license agreement for its DMT technology with Go Entertainment, Inc.

And the question remains ...
how are you proving your "grosse sales" to calculate the 2%?

When Acacia says - "we don't believe your sales figures" now what? Give them all your affiliate details right?

Holly 10-22-2003 08:34 PM

They wouldn't care if they don't have/depend on affiliates. If they provide a service to webmasters or take payments from them, they'd still have addresses.

Companies who've gone belly up (think: processors) lately, or know that they soon will be, don't have much to lose either.

for the love of R-n.

affiliates in our business and the way we refer to them is NOTHING like what the legal term that acacia is using means.

acacia uses affiliates to refer to companies owned by your company. like gm owns direct tv. so directtv is an affiliate of gm.

but my local magazine advertises direct tv, and lots of local entrepreneurs sell direct tv for a comission. that makes them "advertisers" and "comissioned sales reps"... not affiliates.

the phrase "affiliate marketing" has gotten all twisted out of shape.

Yes, but an affiliate program still could have provided their affiliates details in order to cut a sweet deal.

And the only reason they were shut down is they didn't respond to summons and didn't show up to court. Default judgement?

Not until they responded after having their sites shut down did they get back up.

---------------------------------------------------------------------------

sexeducation,

What does affiliate info have to do with gross sales? They can confirm gross sales with tax returns, etc. They do not need affiliate info, nor would it help them confirm anything. Most large programs produce a lot of their own traffic and there is no direct and accurate coloration between affiliates and gross sales.

Speaking on behalf of Hustler, if they wanted to verify gross sales, we could easily do that without ever giving affiliate information. If they requested affiliate information for ANY reason we would deny them. Period.

Acacia asks for percentage of sales from processors.

Epoch/iBill/CCbill give up this information.

That's what you are saying ...
and you have valid points ..

But so is it a valid point - "aaah lets just settle - it's only 2%" ...

and so it is a valid point - "aaah it's to much work - just dump the affililiate dbase and give it to them" ... "one more step won't matter" ...
?

I will NOT report to ACACIA who my members are.

Platinum Dan 10-22-2003 08:55 PM

In our contact with Acacia ... our lawyers were careful to specifically state that 'gross sales' only applies to membership sales.

That is Epoch, CCbill, iBill, WTS Checks, Electracash Checks, etc ... revenue

and nothing else.

So any audit would only require providing revenue info for these processors -- and this would be done through our accounting / law firrms.

No webmaster information was ever nor will ever be released.

Platinum Dave 10-22-2003 08:56 PM

they want percentage of sales

processors give them sales totals

For the uninformed posting in this thread:

SexEd is a half-crazed, kiddie loving, pervert who is completely delusional. Please don't waste your time responding to him or thinking that he actually has a lucid thought in his demented head.

On a side note, you will also be noticing that he will continue to post and ramble in this thread for hours (or till the booze/pills drops him), even though no one is addressing him. He will also be putting unrelated and unimportant phrases/words in "quotation marks" and announcing idiotic things such as, "I will not report to Acacia!!!!" "They have no rights to my member's database!!!" "Where do I get the report form??", etc. Of course, no one gives a shit about any of this, or knows what he's talking about.

This can easily be confirmed with virtually any member of this board.

Thanks.

What bothers me about all this is they want gross sales; so say:

$1000 of your ccbill gross -- you really end up with about $500-600 of that after affiliate payments, and ccbills thirteen percent.

It seems that they want your gross sales, so even if it is that 2% you are really giving 4% or more of your income, because the true gross in my opinion is what you get as deposits from ccbill after all those payments.

But I guess that they do not look at it this way, and that is what really gets to me.
