				Ever sue a freelancer?
			 Has anyone ever sued a freelancer for initial deposit back for incomplete work? I'm not interested in discussing the specifics of my current situation, just wondering if anyone has done this? |

				 | Well most of the freelancer game is overseas  is this the case?  India, Russia? If in the states you can do small claims court thats one way but thats a bitch and most likely cost more in time and effort than its worth.

				 | I was about to sue one freelance writer from California. I paid her for exclusively written adult stories but instead she gave me some stories downloaded from newsgroups. Obviously she thought she would be safe since she was overseas. But when my US lawyer called her home, she almost got a heartattack. And I got all my money back (after she had to sell her car). So basically the best thing is to get a lawyer in the same area where the problem is and get him on the case. |

				 | This just happened to me... His email address dead. No phone number. Only $100 so a debt collection agency won't touch it. $250 for a lawyers letter approx so would lose more that way. Fuel to his house there $50 and $50 back (if it is his house, found out it was different card details to name he was using with me). I was scammed. If it's a small amount. Move on. |

				 | depends on what level of freelancer you're dealing with. "Freelancer" can mean anything from a legal business entity to a kid working in his mom's basement. Up to you to figure out if it's worth going after this "freelancer". Suing often is the kneejerk reaction to many peoples problems with just about everything, but that doesn't mean it's always the right solution. If you sue someone that can't/won't be found, or someone that really IS working from mom's basement, or if you're talking about a couple hundred bucks or something, chances are suing is not only a waste of time, but also going to be more expensive for you than simply cutting your losses. So I say again.... it really is up to you to weigh all that out and figure out if suing is the right option to put in motion. Only you know the details of your situation.

				 | Ok, after reading some replies, here are a few details... This person is in state (FL), I've met with him a couple times. I was promised a 2-3 weeks completion period. It's been about 5 months. Money wise, over $1000 so far paid. The problem I forsee is that this was a verbal contract. The person came recommended so I didn't form any written contracts. I'm very patient and reasonable due to the fact that I'm not strapped for cash, but shit like this really pisses me off after a while. |

				 | You know its funny. contracting in this industry and having a good reputation for reliablility, i have gotten about 50% of my business from people who hired some programmer in like poland or bulgaria and the guy just disapears on them. so they call me cause i dont disapear. the moral of the story is that you really get what you pay for. my rates are higher than that of somebody over seas, but you get reliability and quality and accountablility for what i've done.
