Standard ChargeBack LETTER.

Ok when a surfer does a chargeback i want to let them know that I KNOW they have done it and follow it up by sending a letter to them - giving proof they purchased and tracking number if a physical product.

Anyone got a standard letter I can use for this...

Just got a $248.95 chargeback the first CB of the mnth and pissing me off.

Chargebacks are such bullshit. Sorry I really don't have a letter to help you. Does the processors share chargeback users info with each other? I would assume they probably don't. It would be nice to have a master list somewhere to ban these fuckers. My problem is someone does a chargeback and the processor can do pretty much nothing about it. Can't they contact these people and tell them if they do a chargeback they will be blacklisted from buying things online or something of that nature?

Well that would go in my letter as well I suppose. I know theres a company on GFY whioch actually specializes in this stuff (anyone know who they are?).

Thing is we shouldn't have one chargeback. Our support answers all e-mails within 24 hours, everyday all our orders are double checked, every person buying from us gets our contact telephone number for support etc etc... so it kinda pisses me off.

Yeah we have 24 hour telephone and email support as well and working cancel pages etc. But you still get those fuckers that never bother contacting you and just chargeback. They should make it so you HAVE to contact the merchant before authorizing a chargeback so you might beable to work it out with the merchant first.

This IS actually the policy with all the credit cards I've ever owned. I've tried to charge back a futon cause these dickwads were giving me the run-around with their policies, and the credit card wouldn't let me until I could verify I had talked to the merchant first, and were unable to reach a compromise. The funds were charged back, and the merchant was sent a request for their return policy statement... so I know they do seek to communicate with everyone involved. Perhaps it's different with soft goods??

well thats a load of shit, i would say 9 out of ten times the chargeback is from someone who as never emailed or contacted us at all....

We always send something out on below lines, depending on the amounts info taken etc....we manage to recover around 20 to 25 percent of monies taken this way.
Last success was 1 fucker who ran 6 months of cbacks alas sadly the sad fuck was in the same town as us...he coughed up within 3 days cash!

Actually, it just has to do with the merchant catagory code. As sson as the issueing bank sees an adult MCC, they just hit the chargeback button, without going through a retrieval request first.

It has come to our attention that you have recently charged back your purchase of a membership to PORNSITE NAME. You may not be aware that charging back legitimate charges is credit card fraud, but cancelling legitimate charges is a federal crime.

You can avoid any further collection or legal action from us by sending the full amount owing us for $X.XX.

I'd like to first caution you and anyone else who attempt to directly collect debts from consumers. You may be subjecting yourself to liability under the Federal Fair Debt Collection Practices Act (FDCPA) or state collection laws that govern the collection of debt by businesses. Debt collecting is highly regulated by both the states and the federal government.

Did you know, for example, that if a consumer asks you to stop contacting them that you can no longer send any communication other than notification that you have filed a lawsuit. Some states require bonds or licensing fees to be paid before you can collect debts in their state.

If your business starts using hardball tactics and a consumer reports you to their state's regulatory agency, do you think they will have much sympathy for an out-of-state pornography business that isn't licensed to collect debts in their state?

AdultRep is able to collect debts in all 50 states because we have obtained the appropriate licenses and posted the appropriate bonds with each state that we collect in. The regulations do vary widely state-to-state, so AdultRep has agreements with collection agencies in each state that we are not licensed to do business in. We just had a guy call and say, My credit card was charged for a site that I didnt signup for.
Truth is, when the Cust Serv Rep looked up this acct, he had
signed up for 6 sites, he told the guy and the guy said, impossible, I just now heard about the internet.

hahahahhahaha

Its sad, but there are some dumb asses in the world.
Honestly, I can see someone requesting a refund for
one site, but 6??? That should be a flag for the CC
and tell the thieving bastards to fuck themselves.

You just stumbled on the $64,000 question -- how much can we recover. You're not going to like the answer: We have no idea until we start working on your chargebacks. The amount we recover depends hugely on several things:

* Whether the customer actually made the charge (as opposed to a husband /boyfriend / kid who was using the customer's credit card)
* Whether the customer knows how the system works (professional debtor)
* How much was charged back

Recoveries vary widely among clients. Some websites seem to attract a lot of professional debtors who know that they cannot be touched. These guys always seem to live in Texas or Florida -- two states that have the worst debtors laws in the country. Even if you have a court judgment against them, in Texas or Florida, it is almost impossible to collect.

With some clients we are hovering around 5%. With our best client, we're able to reverse 50% of all his chargebacks (friendly merchant bank) and collect on a large number of the ones we can't reverse. It really depends on your own situation.
