Can a model sue a gallery maker?

I'm wondering if websites can be held liable by a model in how they are represented?

What if I make a gallery promoting a program with a quote seemingly coming directly from that model saying something bad like, "I only posed for these photos to fund my crack habit, and if you think that's bad I've been a prostitute since I was 15."

Could the model sue for that fake quote?

all depends on what the contract said that she signed. I was way misrepresented and not a damn thing i could do about it legally. Cover your ass in the contract saying that you may repesent these images any way you or the ones who buy them want and you should be fine.

This also brings up another point. What if a straight guy poses for a content provider, and then those pics end up on a gay site (gee, didn't think that was possible) and they print that he is 100% GAY. Could he then sue the site?

Same thing with solo girl photos. What if I attach a quote like, "Click here to see my lesbian lovers."

Just where is the line?

The majority of model releases that I have read recently do not cover for humilitation and reputation, so I'd be very wary.

Yea, read the model release very carefully...it always surprises me when I'm at a shoot and I hand the actor a release...they flip to the back page and sign away. The release I use allows me to, among other things, resell the content to whomever I want, market the material any way I want -- even if involves comments that may be degragading in nature -- and even use computer generated graphics that exactly resemble the model in the shoot when and if they are invented in the future...

And I've spoken with more than one male actor who has seen solo clips/stills of himself during a shoot with a girl end up in fag rags...

The model release says it all. In our case, our model release states that we OWN the pictures, can do anything we want them, and can create any persona we wish for the said model.

Most of these models don't have the resources to come after you in court.

Depends.. if the photographer was smart, he included something in the model release that indemnifies anyone using the images for how they protray her. If not, well there could be problems.

its all about the model release haha but the senator's right, you can sue anyone for being born if you want! doesnt mean your going to win...

they can't sue cuz any standard release form covers that stuff but i know of several that were very unhappy about how they were portrayed on some websites when they stumbled across them.
