KARAOKE DEATH!!! Bar sued for singing copyrighted material

http://www.theindychannel.com/entert...70/detail.html

If this don't beat all! Now they can sue you for Karaoke night and force you to pay a fee for singing a song.

This is getting ridiculous.

Let's start cracking down now for something that's been around for nearly 20 years.

Some quotes from the article:

"New York-based BMI is a performance rights organization that collects license fees on behalf of songwriters when their music is played on radio, TV, the Internet, or is performed publicly. "...
""These businesses are using the music to draw in people to eat and drink," he added. "...
"Parrotheads would likely have to pay annual license fees of about $1,000, said Jerry Bailey, a spokesman for BMI."

So this lawsuit, if successful, would make it illegal for bars and clubs to play music w/o paying a $1,000 license fee PER SONG, would make jukeboxes illegal if they don't pay the fees per song, would make playing your stereo loud enought for anyone else to hear illegal w/o paying per song, and would make it illegal to hum or sing a tune w/o paying. These are *all* public performances, after all.

Let's all be happy that stores that play elevator music usually purchase the music from collections that include a license fee. Elevator music for everyone!

Hmm, if I hum a tune in a forest and nobody hears, do I make an infringing sound?

Dear Mr. Baal,
My client, Gornyhuy, has asked me to inform you that he holds the copyright to the question "Hmm, if I hum a tune in a forest and nobody hears, do I make an infringing sound?" Please cease and desist using this question in the future, or we will be forced to avail ourselves of any legal recourse which will compensate my client for his losses due to your negligent and unlicensed use of his intellectual property.

Best Regards,
A. Torney

Exactly! If they're singing to background music, didn't they have to buy it in the first place?

This is part of the 'frivilous lawsuit' craze that's fucked this country up since the late 60s.

Everybody is out to make money by finding a reason to file a lawsuit. I've had to handle this type of thing for years. Yet don't fret because there's a big danger in filing dumbass lawsuits.

Thanks goodness we've got the checks and balances to stop and penalize people for initiating such vindictive and suppressive actions in court.

http://edition.cnn.com/2003/TECH/int....ap/index.html

No sooner posted than hit the headlines!

This CNN story focuses on the backlash from the RIAA lawsuits.

Of note here is the PUBLIC choosing not to buy the high priced CDs and the PUBLIC's complaint of stores not offering enough varied music choices.

How many times have we heard that??? Decades and decades of radio stations not playing the 'new' guy til the PEOPLE buck the system, make the guy popular and then the radio stations play him. From Little Richard to heavy metal to rap it's the same story over and over again.

This time the story is gonna be different. The PEOPLE will make that difference with these heavy handed tactics.

Do you people not realize their is a different license between jukebox and karaoke?

Geez I know half of you arent even old enough to drink let alone be in a bar, but get real.

You cant do karaoke without paying the license fees on the music.

Just because they sell bootleg karaoke on ebay doesnt mean a bar can just use the music.

Im not arguing whether its right or wrong, but there IS a difference.

'In a lawsuit filed Monday in U.S. District Court in Indianapolis, Broadcast Music Inc. alleges an eastside bar violated copyright laws by hosting karaoke and live music shows without paying licensing fees to use popular songs.'

its simple.

Ever heard of a Single ? single = free for use as long as there is no modification .
On a single CD therei s the main track, the beat and sometimes few remixes and shit . This can be played on radio and everywhere withotu worrying . Other tracks on a cd are fully copyrighted . But if you play a single in a club you are legal .

I always thought it was only illegal to use copyrighted material if you redistribute copies of it or sell it without consent/licensing.

damn, I have to read those FBI warnings more closely before the movie comes on!

Thats the dumbest things Ive heard all day.

A song is someone's legally protected intellectual property and they have every right to be paid for its use.

I do believe that there is a commerical and a personal purchase price for a Karaoke CD.(You Know they had to pay the record company to sing the songs in American Idol)

You should pay an extra price if your using it for a profit business

Very similar to Pay Per View shows, You don't think that the same bar paid the same price as you did to watch the fight at home.
