FYI . . .

Yes, it's true that attorneys for PSW Billing have in fact sent notices of their intent to file suit, not only to Visa USA, but also to Visa International, and to MasterCard. And yes, it's true that in 14 days the attorneys will indeed file suit in Federal court against these companies.

There should be information about these lawsuits posted on the PSW Billing website over the weekend, perhaps including some details of specific allegations that the suits will charge. I don't know a page address at pswbilling.com yet, but I'll post it here when I do have it.

And one last thing. No, this isn't the end of PSW, but it may be the beginning of the end of the unfair practices of Visa and MasterCard, practices that have plagued most of us in the adult marketplace for far too long.

And you really think they stand a snowball's chance in hell of winning? What specifically are they suing Visa about?

And wasn't there another billing company that sued Visa? Don't remember the outcome of that one.

If they can't afford to pay webmasters then how the hell can they afford to pay their legal fees? Oh, hang on, I just got it...

PSW employees had a great time at Internext, of course it's easy when you have so much of other peoples money to consume.

If PSW have money at all they should distribute it all amongst their clients proportionately and close their doors.

Their actions to date have been reprehensible and as bad as the worst of iBill.

iBill are thieves, PSW are thieves, third party billing companies cannot accept payments and then not pass them on!

Webmasters have already provided the services to the end user who has already paid for them. Webmasters deserve to be paid for the services already provided. If PSW cannot do this then they probably should refund their service fees as well.

Hmm... no good.

PSW did not play around the rules like ACPay, Globill, and all the others... they charged the $750 to the webmasters and worked "closely" with Visa a couple of months ago.

But now what? This is not good news... I think CCBill, Epoch and all third parties biller will be gone by the end of 2004-2005

Are there any Adult Verification Services (AVS) that clearly state they are adult verification services?

PSW Suing Visa is probably the last nail in the coffin.

What a better way to mask the fact you have poorly managed your way into insolvency than to sue Visa and then lay the blame at Visa's feet ?

PSW knew the regulatory landscape they were operating in, it was clear 12 months ago that Visa was cracking down hard. PSW continued to operate, even take advantage of the Visa crakdown by offering themselves as an alternative to iBill and CCBill etc. Yet here we are now with PSW unable to pay their webmasters and clasping at straws.

PSW, cease business, sell your assets and pay your webmasters. Dont let the last few dollars you have get swallowed up in legal fees while leaving your clients without payments.

There is no way to legally prove you are an adult online?

Credit Card processors have a responsibility to assist in the providing of adult authentication as the exchange of "consideration" is the essence of all contracts.

This answer to your question is PayCom.NET.
The are supporting the virtual anonymous visa.
ePASSPORTe.com.

This is absolutely essential to freedom of speech.
Anonymous transactions AND accountability.

If Visa trys to do anything to stop the adult industry from using this card - then I would participate immediately in a class action.

AVS's should exist too.
SexKey.com needs to exist as an AVS.

This needs to be fixed.

I don't know what to do ...
I am currently halting the reconstruction of SexEducation.com ...

If there is no legal way to prove you are an adult online ...
I say ...screw this ...

And I will point EVERY generic domain I own to GFY.
Get a job and wait until things obtain some common sence.

How do you prove currently that your visitor is an adult before entering?

WTF ...
I give up ...

Well by sueing they are fucked...if they don't sue they will be fucked eventually..as will CCBill..VISA will keep changing the rules until CCBill and the rest quit/go under..

And please no more bollocks that CCBill are working closely with VISA and will remain compliant so please don't worry blah, blah..

VISA are eating these companies alive so it depends whether you want go out slowly bit by bit..

..or go out in a blaze of glory and pray you land a lucky punch like PSW have opted for

Unless processors get together and file a class action suit against VISA and MC, they're all fucked. The CC companies are applying the divide and conquer method. So far, it seems to be working out great for them.
