With a decent lawyer you're untouchable... many cases have been settled out of court for fractions of a cent on the dollar. RIAA's lawyers has dropped alot of cases, leaving people with a tiny fee for their lawyers and an agreement to keep their mouths shut.

But it comes down to this for me: If you have 1k mp3's in your SHARED directory, and you are too lazy to move them out... you deserve to be sued.

The fact is that civil liability can extend to the parents of under-age offenders, even if they were unaware that their child had been stealing. It?s a chilling thought. While you?re downstairs watching TV, thinking your teenager is upstairs studying, he or she could be doing something illegal that could land you in court.

Even more shocking is the fact some illicit "peer to peer" networks, such as Kazaa, actually commandeer a portion of the hard drive on your computer for illegal downloading and uploading by network members around the world. Once you register with them, all the files on your computer hard drive can be fair game. Depending on the settings you choose, peer-to-peer users can explore your computer to find private financial information; confidential, personal and professional data; and other sensitive documents.

          nice scare tactics.

They're def getting desperate. I wonder if these scare tactics will work as planned? Way too many people have become accustomed to getting music for free.

So if you have downloaded 1k mp3's in the past, months ago or so, would you have to worry? Assuming you haven't logged on to any gnuetella networks.

Is it just the people who continue using it with that many files?

As far as I know they can't search around any further than the shared dir and it's own sub dirs, so as long as they can't see those files then you should be all set.

I have purchased over $400 worth of CDs in the past year based on the few really great MP3s that I've downloaded (Some thanks to Fletch XXX... but he isn't even in the commission loop). Before MP3s were easily traded, I'd bet that I bought less than $40 a year in CDs, because I was sick and tired of paying $18 for 1 great track and 17 completely shitty tracks.

Talk about shooting a great marketing vehicle in the foot! The recording industry is about 10 years behind the porn industry with regards to "free samples"... pun intended. Yeah, sue me for researching which albums suck ass, while I buy 10x more of those that don't.

                                  Stupid corporate marketing fucks.

Prohibition worked better in this country than any Internet regulatory laws will.

They need to understand that and decide the best bet was cutting loses, rather than regaining profit.

Look at what Steve Jobs did. By taking something that people can do illegally for free or legally for $1 (download a song) he found that enough people were willing to pay a buck to clear their conscious that his ?itunes? campaign made millions on it?s first day.

The RIAA is smart, they know how kick backs work. They should just stop bitching for the whole pie and ask for a small slice. In the long run everybody wins if they do that.
