The patent does not just deal with MPEGs or MP3s per say. They can exist on your computer very nicely. The patent deals being able to stream in real time or less than real time videos and/or audio that or stored in one location and transported to another over phone lines, cable, or satalite.
Just because MPEGs were invented prior doesn't mean much because the claim is nobody had the insite to think these files would be transmitted over the above mention lines and this is what this patent deals with.
