Never worked for them, so I guess the answer is no, they didn't fire me. Why? You seem to be obsessed with thinking I work for them, so maybe you want a job there?

Since you're making claims that your MPG's are free from Acacia's patent claims, will you be reimbursing people for their legal fees who buy your MPG's and get sued by Acacia?

BRISK 07-26-2003 07:54 AM

A system of distributing video and/or audio information employs digital signal processing to achieve high rates of data compression. The compressed and encoded audio and/or video information is sent over standard telephone, cable or satellite broadcast channels to a receiver specified by a subscriber of the service, preferably in less than real time, for later playback and optional recording on standard audio and/or video tape.

Sounds like MPEG to me!

SoBeGirl Video 07-26-2003 07:57 AM

FatPad,

I am just suggesting, that if you use and follow logic, and understand the difference between the file types, you will be lead to an answer or final decision that is more postive than if you were serving a streaming file such as wmv, asf, or real.

I am not asserting any certainty here becuase with the law there never is. I am only suggesting that you will be better off, and perhaps even out of trouble all together.

slackologist 07-26-2003 07:58 AM

acacia has never made a profit from what i can see, this is their one big chance to actually make some money rather than just spend it.. sure it might be mostly bullshit, but a lot of people make a lot of money bringing bullshit to a court room. (no)

This thread is too funny.

I hope this is not the start again of the daily "create some controversary so I can spam my content" threads from sobe.

Your legal prowess here sobe only makes what you said before about your model releases that more convincing.

My lawyer told me somthing the other day I found interesting.

He said, " Nobody makes money just suing people all the time."

I was going to quote that exact passage. Points to you for actually READING. Something other people just didn't do.

[I saw the Acacia packet online earlier... someone care to point this clause out?]

Supposedly they are trying to double, triple & quadruple dip on down the chain of people they request license the technology

ie:
(1) Content provider/server
(2) Paysite Operator
(3) Paysites Affiliates
(4) TGP's and other ad sources linking to affiliates galleries.

All four being asked to pay them for same piece of content.

And I'm sure if they had a big list of your members they would probably try to go after them too :)

Look at this companies track record.

Does it seem like they are playing fair?

Does it seem like they are trying to build long lasting business relationships with us?

If thats the case, where are they?

They are obviously aware how large this forum is....

Acacia, want to appear more legitimate to this crowd? Come say hello and address some questions, dispell some rumors.

Maybe some of that will happen on Tuesday.

Until a judge tells them what they can and can't do, assume they will come after you for anything. Assume they are claiming everything (the adult industy does with video/audio) is covered by their patents - because they haven't been very specific about it yet as far as I can tell.

But I have a feeling if you think hiding behind .MPG is going to save you, you're in for a rude awakening. I could be wrong, but my bet is they won't roll over and disappear if you tell them "Sorry guys, I've used MPEG this whole time! You've got nothin!".

They'll probably just laugh and push the papers on through the system as planned.

But the patents being justly invalidated - that's what will save you & everyone else. :2 cents:

Maybe I should not bag on you sobe for spamming so hard if the end result is good discussion like that. That one was worth alot more than 2 cents .

SoBeGirl Video 07-26-2003 08:35 AM

Finally something we agree on Scoreman.

So what do you think?

Are they doing just that? Just pushing ahead and suing everyone?

If my lawyers logic is correct, then we all have nothing to worry about.

They will one day just run out of steam and go away?

Like a lot of dot coms?

Is that what you are saying?

scoreman 07-26-2003 08:52 AM

Are we agreeing that you are spamming your goods under the guise of controversary?

Acacia is not going away. They have millions in their warchest and 14 total employees. (more proof that they innovate nothing and litigate everything). Take a look at their last filings with the SEC. $49 million in cash in the bank and they are burning about $6 million per quarter on revenues of $222,000.00. Acacia releases their next quarter earnings next Tuesday after the market closes. It will be interesting to see how things are changing in their financials.

Stepping away from the legal issues, I find it difficult to believe that the shareholders of ACTG will let them continue to burn $24 million per year with only $49 million in the cash. Granted they have lines of credit and might even do another stock offering, but logically it would seem that Acacia will have to start generating some income here or face shareholder revolt. Of course this all assumes their costs will remain as high, which is unlikely since marketing costs were $4.2 million this past quarter. Those fancy packages they sent out didnt come cheap it seems, but this cost is not ongoing. It they were to funnel the majority of their cash into just litigation, the industry has a tough fight ahead.

Mutt 07-26-2003 08:58 AM

Acacia loses this first case against the first 10 porn defendants it's over. Their stock is in the shitter now, if they lose they'll have other things to worry about - like getting hunted down by their irate shareholders.

How long are they predicting this case will take to be heard? How long do judges usually take to make a decision in patent cases? weeks? months?

Far-L 07-26-2003 09:13 AM

Sobegirl: Who are you getting your legal advice from? Your cousin Vinny?

"If my lawyers logic is correct, then we all have nothing to worry about.

They will one day just run out of steam and go away"

Did your attorney advise you not to respond to Acacia too?

scoreman 07-26-2003 09:24 AM

I think Sobe would argue the earth is flat and Elvis is still alive if it would get thread views on his content sale offers. He hasn't seen a lawyer on this Far-L.

To serve MPG you do not need a streaming server. Just a hypertext link and you are off. What will Acadia do next? Sue everyone who ever used a hyperlink.

Yea, there I have it. I am going to sue anyone who used a hypertext link. I have a patent on that and I want on one hundredth of a percentage for every click.

I think that if you have MPG you are much safer from this kind of litigation.

Hey Sobe,

You may want to talk to your patent attorney, I think he lied to you considering British Telecom owns the Hyperlink Patent already. :winkwink:

http://www.google.com/search?hl=en&l...perlink+patent

Fortunately, trying to enforce this patent hasn't gone so well for them up to this point.

Cassie 07-26-2003 10:13 AM

acacia went from a 23mil dollar company to and 800thou company. i am probably pulling at air here BUT think about this, they got sued for stealing another company's patent and they lost. they lost their v chip suit; maybe, just maybe they are trying to find a way to bankrupt themselves without bring any unnecessary attention brought to their books. suing on this patent may be just a way for them to lose graciously and bale out.

again, i am pulling at air but it is something to think about. if a company has such solid footing for a lawsuit like this, then there would be no logical reason in the world why they wouldn't hit the larger companies. that whole pick on the small guy is starting to sound fishy if you put the effort into reading about them.

They live off the COWARDS that poop their pants and pay them protection money hoping to avoid a lawsuit.

they will loose in court.

Cassie 07-26-2003 11:43 AM

i forgot to add their little venture capital deal that went bad. if you add all this up, financially they are in some serious trouble for the are more high risk then any porn site out there.

this may be their last attempt at strumming up some money.

food for thought.

So what do you think?

Mpegs are included in Acacia's patents, regardless of any SPAM to the contrary.

SoBeGirl Video 07-26-2003 02:12 PM

Certainly I can prove that I can sell all my content on ************* for whatever price I want to becuase I own all the content on *************.

No court will ever rule any differently. You are in dreamland and spreading the usual lies to prevent people from buying reasonably priced content packages from SoBeGirl.

You do this so that you can keep your prices high.

I can do whatever I want. My webmasters love SoBeGirl deals and they are what is important to me.

I pay no attention to what other content providers say. It is always the same rehtoric. Go tell it to J$styles.

A dork? Are you kidding me? Come up with something a little better there buddy.

You're absolute scum. Probably the scummiest of content providers that I've ever had the misfortune of dealing with. No, I've never purchased content from you (thank God!) but I have sent you 2 clients that purchased your whole library of videos during one of your last sales. That was probably one of the biggest mistakes I've ever made.

I wouldn't trust you with my enemies child. Right now, in this very thread, you're claiming that you're immune from ACACIA and trying to convince other webmasters to purchase your content with the claim that ACACIA won't touch them either.

Fuck you. Lying to others just to pull an extra sale. I don't know what your agreement with Joe at AMA Content is, but I'll definitely take his word before yours. You'll get what's coming to you.

And by the way, yes I like boobies. Got a problem with that?

Interesting info! I smell another "dot com bust" with Acacia. All based on little but the anticipation of a sucessful judgement.
Hell.. what a waste of time all round!

SoBeGirl Video:

It would take a judge 30 seconds or less to dismiss your arguement - *if* he/she wanted to even listen to it in the first place.

SoBeGirl Video 07-26-2003 03:47 PM

Holy Cow RJ, I never claimed that if you buy SoBeGirl Videos you cannot get sued. I just said that I think it will help your defense if you serve MPG files.

You are like a firecracker Man, you really went off there. I think you should get your blood pressure checked or somehting.

Are you calm now? I have done nothing to anyone and you know it. Joe and I made a deal and he does not like the deal he made.

You sent me two customers and that was the biggest mistake you ever made? Why is that? I am really curious.

Is it going to be the "you stole content story again?" That one is really getting old. Or is it something else I should know about?

Please do tell.

Does it matter? You are still very, very wrong and his point is still valid.

SoBeGirl Video 07-26-2003 04:04 PM

I could be wrong in thinking that if you serve MPG files you are safer legally with regards to Acadia. I might be wrong. I might not be. One judge might decide I am right. Another one might decide I am wrong.

So what is your point? I could be wrong. Yes you are right.

SoBeGirl Video 07-26-2003 04:17 PM

So I see that IMPA is affiliated with home grown Content.

Isn't HomeGrown one of the companies that is being hit hard by Acadia?

I think they are one of the companies that does not want to settle.

So tell me RJ Sly, did homegrown serve only MPG or are they using streaming video formats such as ASF, WMV, Real?

I don't think they use MPG.

Sly_RJ 07-26-2003 04:21 PM

Sobe, if you can't read and comprehend the existing threads and materials relating to the ACACIA patents than I am surely not going to waste any more of my time trying to describe them to you in kindergarten fashion.

Get a copy of the ACACIA patent, take it to your teacher and have her explain it. I'm sure she'll be glad to help.

SoBeGirl Video 07-26-2003 04:25 PM

I don't need to read it. Becuase when they come to me I am going to tell them I serve only MPG files which are a download able file type and not a streaming format. And I will win.

It is just a typical hypertext link to a file just like any other. Are they going to sue me for hyperlink technolgy I am using too? If so then I am in trouble.

I am not using anyones patent or technology. They were not even around when MPG was derived.

SoBeGirl Video 07-26-2003 04:44 PM

Once again the content provider that can't compete talking trash again. Where are the other guys. Araon?

And the facts are that the MPG file format is not a true streaming file format. That is the fact. It was originally designed to be downloaded and then played.

Streaming files are not designed to be downloaded and played. They are designed to be streamed. Streaming is the buzz word here. The definition of which might be in question.

Those are the facts.

Get off my back, I serve MPG and I feel safer. That is the way I feel and others should too. Safer not lock down tight secure safe but safer.

Hey GFY readers look closely, you will see that a lot of the people who disagree with me here in this thread have some sort of interest in streaming vidoes. Specifically they sell the technology and would hate to see people jump ship all of the sudden for some great low priced MPG content deals.

For example it would be a shame if SoBeCams, my plug-In streaming product using streaming technology lost a few customers becuase they figured it would be better and safter just to buy 200 SoBeGirl content sets for around 1500 dollars.

With all that content why do you even need a steaming plug-in? Readers, did you consider this?

SoBeGirl Video 07-26-2003 05:29 PM

Obviously fiveyes is out of breath.

He keeps starting a new thread on this subject so that he can dodge the facts.
