i'm not really sure. i assume they check high traffic sites like the hun and track down every domain being linked. very easy to do. i was actually one of the first to be contacted, so you've got to laugh at all the hype about Canada being some sort of haven.

They dont have a patent in Canada. So it is a haven. We are a Canadian company and therefore are not breaking any US patent laws.

On top of that......Canada does not have a patent treaty with the US. You will find that is so "in the package".

it's strange... I mean are they just hoping that people that don't need to sign up do so because they aren't aware they have no patent in that particular country? I find this to be a confusing issue, but it fits in with their modus operandi.

do you process in the US? if you aren't a paysite, do you use a US sponsor for your income? Do you host in the US? Do you do traffic deals in the US (or any country that they do hold a patent in)?

promoting a US sponsor that isn't doing anything illegal in your own locale isn't a canadian's problem. It's like saying the hun is liable for the beast stuff he promotes because it's illegal in the US.. not so - it's ok for the netherlands.

the only thing i think they could get you on would be hosting. don't get me wrong im not saying they're not bloody minded enough to try get you on everything but most people should be able to swat the rest of it down pretty easily. Don't take this as downplaying the threat, just trying to rationalise the situation.

im not doing that - as a hypothetical though, I don't see how it would make you liable. I looked into patenting a product, nothing to do with the internet and this situation, but you're basically pretty screwed if someone in an area not covered by the patent is pushing it. You can go after someone in your legal duristriction and try and stop them from infringing on it, but some barely affiliated third party in thailand pushing the product the infringing company created?? maybe I wasn't approaching it from the stance of having millions of dollars to waste scaring people..

Servers are certainly located inside the USA therefore you can't break patents inside the USA. Its like that beastiality is legal in the Neatherlands but you sure don't see any beast sites hosted in the US now do you??

This could be the mistke they made, there must be international laws governing the restriction of free trade. Do they have the right to stop non US companies trading, if they are not based in the STates, hosted in the States or money is processed in the States can they legally stop us?

If a US webmaster buys from us who is breaking the law him or us?
