Acacia package, just by normal post, answer?

Hi,

I know a guy who got his acacia package as well(in The Netherlands) it was send by the "normal" post. He didn't had to sign, was just delivered by the mailman....Can he ignore this? Because in The Netherlands you have to sign for important mail to show you actually gotten it. When not signed, you legally maybe never got it.

Andre

I see, but "normal" mail is often lost... When I want to sue someone, or have important papers, we legally have to send them by signed mail...What did you do (btw you are canada right? I saw they don't have patent there?)

Can you just ignore the first package, till they send a signed one?

Andre

They can still take court action against you if they want. Ignorance of the law doesn't exempt you from it.

This past week, a California court issued injunctions against 5 porn companies because they didn't respond to Acacia. The injunctions prohibit these companies from infringing Acacia's DMT patents by transmitting compressed digital video information from any of their websites.

again, regular mail doesn't do a thing.

default judgments don't do much, either. but those companies referenced above were served either in person or thru a registered agent

Yeah saw that.
BUT, imagine, I say I have send a letter to you. But I didn't. This way you don't respond to me. SO I win in court? Futhermore, sometimes mail get lost. Things like that happens. So when my mailman lost my mail, I will loose? THink that is stupid.

You seem to forget that Acacia can serve you anytime they want. The package they sent out is just to hopefully get you to pay them without them having to take court action.

They never had to send that package, they could just take immediate court action against everyone if they wanted to.

So ignore the package if you want, but the next one may be a court summons.

what else did you say besides that and that regular mail was acceptable for service of process?

As I said, everything you wrote was drivel and bs.

Where did I say that regular mail was acceptable for a subpoena?

I said Acacia could take court action anytime they want.

You never mentioned the word 'subpoena', but you jumped in to the thread when we were discussing regular mail.

And yes, any idiot or idiot company can file a lawsuit anytime they want. But it still has to be served properly otherwise the courts won't take any action.

ok, I guess you got my post mixed up with all the regular mail chatter.

My point was that Acacia can take court action against you anytime they want. They don't need to prove whether anyone received that intro package with all the information they sent out. My point was that you can ignore the package, but that doesn't prevent Acacia from taking court action against you since Acacia never even had to send out that package at all.

Okay. That makes sense to me. Hopefully the first court cases start soon, so we can forget about acacia

I think the next court date is July 28th.

Another interesting thing is that I think Acacia will be releasing 2nd quarter financials on the same day. It should be interesting to see how many millions they're still losing.

We got a letter from them yesterday here in the USA along with a CD. Idiots must have sent out a batch, pity our head office is in the UK and if they want to file suit against us they will have to do it in the UK and have the case heard there as well. Sure hope they have a ton of cash ?

That's what this latest drive is all about trying to scare up some cash to fight the cases they already have . If no one pays they may very well go down, under the shear pressure and expense of existing suits ?

Uh, if no one pays then the websites that have been served have to win in court.

Acacia is losing a LOT of money, but they still have around $40 million left to burn through. At their current burn rate, I think that gives them about 1.5 years left until they're out of cash.

Courts can seize monies owed and not being paid in judgements usually.
