JMM can you tell us how many donations you have received to date so that we can see if this is working or not.
I can tell you that so far, the response has been good.Comment

Adam.. you hit the nail on the head. Part of Acacia's strategy seems to be to go after the little guy. Attack those who cannot afford to fight in an effort to validate their patents.Originally posted by kingadam
Well, I just got my letter and packet in the mail.
I am a no one in this business, and some how I've been targeted. I started reading through the paperwork they sent, and I am totally confused.
It even says that if I have leased video feeds on my site, I still have to pay and I'm responsible. How can they do that? That means the company that provides the feed has to pay, and then the company leasing it has to pay. That's paying twice for the same thing. That makes no sense. Its like if I buy a special blender from the store, and the people that manufactured the blender are in patent violation, I as the consumer would be responsible. That's just fucked up. What has the judicial sysytem come too? How could any intelligent judge rule in their favor. Its also like double jeopardy. You can't be tried for the same crime twice, but Acacia is trying 2 companies for the same thing.
My donation is on the way. I wish I could afford more, but I'm just a small fish in a big pond. I still can't believe someone as small as me got a letter from Acacia.
Please let me know if there is anything else I can do to help. And I will keep posting bump to keep this thread on top. Someone should pin this shit. It is important to anyone that does business on the internet.
I'll say it again, loud and clear, for anyone who has not yet heard me say it before:
IT IS THE POSITION OF THE DEFENSE GROUP, AND THE IMPA, THAT THE ACACIA PATENTS ARE NOT VALID. WE WILL FIGHT VIGOROUSLY TO INVALIDATE THE ACACIA PATENTS IN A COURT OF LAW AND PROTECT OURSELVES, OUR BUSINESS, AND OUR INDUSTRY.
If you have received a packet and would like to talk, or if you would simply like more information, please feel free to contact either myself, or [email protected]Comment

Don't apologize for your question, it is a valid question.Originally posted by kBizzle
Not to sound like a pessimist, and my intentions are good when I ask this question- for benefactor's of this fight will there be itemized breakdowns of how the money is being spent? i.e. legal costs, court paperwork, etc?
I have been speaking with an outside group of investors who want to be involved in this fight but they need to know all the players involved and the expenses that IMPA is forecasting that's all
thanks in advance for your answer JMM
:-))
The answer is, it is not something we have addressed. The board will discuss this at our next meeting. We have no problem disclosing certain information. If there are people that want to support this fight and are going to require certain disclosure, we would be more than happy to speak with them and handle each request on a case by case basis.
We have nothing to hide.Comment

This isn't about greed. It is about so much more.Originally posted by kBizzle
Well I for one commend Greg Clayman, JMM , HomeGrown and everyone else who is advocating on the side of the adult webmaster.
This business has never before banded together and for the mere reason of GREED. Now, that it is imperative to unite and help each other out for our own longevity in this business, I am making my bet that everyone together can make this go away.
It's going to take a lot more than just doantions however- it requires great "hook up" if you know of any hot shot attorney's in your area, you should ask them if they are familiar with this kind of case and if there is any interest- we simply need to find the smartest people for the cause right now.
My gut feeling is "why hasn't the IMPA contacted famous FREE SPEECH atty's? or have they? In a day and age where every attorney is a CNBC pseudo journalist, don't any famous attorneys see an intrnisic value to debating our side?
I would like to hope so.
Also, this isn't a free speech issue. This is a patent issue. When the defense group selected the law firm we have working for us on this case, we did so with the feeling that they were the finest in the country. After working with them for the last few months, we no longer FEEL that they are the finest, we KNOW they are the finest. We have a tremendous amount of confidence in our legal representation.Comment

DONATE HERE: www.impai.org
There are over 5,000 webmasters on this board. Even the smallest free site owner should give up a few bucks for this, because it is our sponsors that will suffer if our side loses. If our sponsors are affected, it trickles down to affect everyone.... affiliates, designers, brokers, EVERYONE. Don't sit there and think "I don't use movies on my site, what do I care?".... if you make money by sending traffic/clicks/signups to a sponsor then you need to start caring.
I Donated, and will donate again a few more times over the coming months. I challenge all the thousands of affiliate webmasters out there to make at least one donation, any amount. Hey, when our side wins you'll be able to say you HELPED, and you will sleep better at night knowing you did your part, you did what you could.
Again, DONATE HERE: www.impai.org

From the last D-Money show interview I think Lensman thinks the IMPA is not handling the case properly. Something about the IMPA should be suing Microsoft or trying to drag them into the fight.Originally posted by Daymare
this thread SHOULD be pinned. Lensman has a lot to lose as well if Acacia gets away with this extortion.
Then again, his board, his prerogative to pin or not pin. We should be thankful this forum is here to educate webmasters about Acacia and the IMPA.HOMEGROWN CASH, sponsor site of Homegrown Video - The Largest Collection of Amateur XXX

I've got another question. Are there countries that Acacia does not own the patent in?
I've heard rumors that they don't have it in Canada and some other countires in South America.
Could you please let us know if this is true, and if so, what countries they don't have the patents in.

Because of the way IP law works, this is a tricky question. It also doesnt really matter. If the patents are proven to be valid, and you are outside of the U.S. they can still get you.Originally posted by kingadam

ok...but what if your billiing company, hosting company, upstream provider, etc, are all spread out between countries where their patent does not exist. So, how can they take your company to court in another country where their patent does not exist, and how can they take your money from a processing company that operates in a country where their patent does not exist, and how can the stop your hosting, if its with a company that is based in a country where their patent does not exist?Originally posted by JMM
