If i make an AI programme, and it becomes self aware and infects other computers and starts a nuclear war, am I legally responsible?

No, you won't be legally in trouble.

The AI will be a completely separate entity with its own consciousness. You, as the creator, will be considered a god. There is no law that states a god can be legally prosecuted. However, atheist groups may certainly attempt to harm you to have the act of "killing a god" on their record. While they are unable to kill a biblical god, they may target a human perceived as a god.
