No, you can't do an IMG src to a domain as an attack, which is what this moron is doing. If you have a clue juicy, you'll give his host a call and tell them what he is doing. It's possible they will shut his dumb ass down.
This is costing you money (bandwidth), so that's directly attributable to damages. It could also be construed as an attack on a server (attempting to overload juicys server) so can also be considered a DOS attack, which is illegal.

Although what he is doing is wrong, I seriously doubt a host is going to shut him down because he is doing it. I dont know how much traffic he gets, nor do I care but the simple fact is no one is going to turn off a major bandwidth consuming account just because someone makes a simple complaint. I would bet the farm he would get laughed at.

Money is money, but the FBI is the FBI.. They are based in Seattle (Flying-Croc), and they seemed quite surprised and concerned when I just finished talking to them.
Sure, they probably won't want to shut him down or take corrective action, but this is plain illegal, and now that they have knowledge of it, they would be an accomplice after the fact if they did nothing about it and charges came up.
