Sites with Bogus 2257 "Custodian of Records" info
Content providers should run some searches on Google for strings of their "Custodian of Records" info. They might be surprised where they find themselves listed.
While updating info for some of our licensees, it was recently brought to my attention that there are many site owners who have fraudulent 2257 info posted on their sites. They apparently just take one from what they feel is a reputable site make a few changes and post it as their own... We have found more than a few with pages wrongly listing BestAdultContent.com as producer of content for their sites. We have never licensed any material to them, and we do not want to be listed on these sites. We have notified several and requested that we be removed from their lists, and have been ignored by some. I am not a lawyer, however I believe falsification of a Custodian of Records statement is a violation of U.S. law. TITLE 18 PART I CHAPTER 110 Sec. 2257 Subsec: f. It shall be unlawful - (2) for any person to whom subsection (a) applies knowingly to make any false entry in or knowingly to fail to make an appropriate entry in, any record required by subsection (b) of this section or any regulation promulgated under this section; It sounds like this would make anyone posting fraudulent 2257 information on their sites in violation of US law, and in all likelihood, also the terms and conditions for both their hosting and cc processing companies. I hate having to notify processors and hosts but when the whois info is fake and the email addresses on the sites get no response there is really no other options remaining. I am amazed some of these sites got processing to begin with...
