    CrakRevenue - Ethical Content Policy

    I think Mastercard startet it, now CrakRevenue follows.

    To that effect, we require that our ads only be displayed on sites that:
    .....

    Its owner has appropriate documentation and record-keeping pursuant to applicable legislation and regulation pertaining to the performers being 18 years of age or older (i.e. 18 U.S. Code ยง 2257)

    How am I supposed to have any documents, if I use content from sponsors?
    I know, my english is bad. But your german might be even worse

    If they're asking to see docs for given content, point them to sponsor/2257.

        This will just lead to sites having fake boilerplate 2257 pages. If the card companies push ad networks to ENSURE all the sites they publish on comply with October's new rules, THAT would be something.

                    The new Mastercard rules apply to producers who are using Mastercard to process payments. It should not apply to affiliates though you may be targeted at some point if you have a lot of pirated content on your sites.

                    It sounds like they sent out a blanket notice because most likely they do a lot of business with tubes etc who may also have premium versions.

                    Want to be sure? Ask a lawyer.

                      This entire exercise is a CYA situation. Can anyone explain to me enforcement? How will people check these IDs? What if they are fake?

                      Will tubes etc require copies of all IDs and 2257 docs for every video uploaded? So that would PH et al would hold millions of people's IDs? LOL Yeah I don't think so.

                      All it will be, in the end, is a form you check boxes off. That's it. Nothing else is enforceable IMHO.

                          We are not asking that you provide us with any documentation whatsoever.

                          When speaking about content from sponsors, they are the ones responsible for providing you with content that they have all of the rights to and that is legally compliant, but this is not what we refer to here (even though it is super important).

                          Weโ€™re only looking for site owners to have appropriate documentation and record-keeping if and when such regulations are applicable.

                              Yep I agree. it wouldnt surprise me if they have a rethink about this between now and October.

                              There's no way to police it and as it stands, they are basically saying they dont want to be associated with any site that allows users to share content (which is pretty much every social media platform)

                                  This is much like Age Verification. Plus, the language I have seen so far seems to focus on tube sites and 'user generated' and 'user uploaded' content. Paysites that buy and shoot their own content have little to worry about, I think (not a lawyer).

                                  This would include live cam sites. But those places should have their own age verification and 2257 ducks in a row. So it's probably the tube sites that will feel these changes the most.

                                    Apparently Cams need to be reviewed 'real time'.

                                    Below is what we have been advised by our processor

                                    User Upload Sites (Tube sites, Fan sites, Adult dating sites, any site with user uploaded content)

                                    • Enter into a written agreement with any individual that is contributing content to the website. This includes the individual’s consent, their identity and age.
                                    • All persons depicted in the content must give consent for the content to be distributed and downloaded.
                                    • Age and identity of all persons depicted is required.
                                    • Only verified users can be permitted to upload content.
                                    • All content must be reviewed prior to publication, or real-time if it’s live streamed, and no content can violate the Card Brand BRAM policies
                                    • Website must have a complaint process for reporting, review, and removal of violating content.
                                    • Have policies in place to make sure that the website cannot be used for human trafficking.
                                    • Provide monthly reports to acquirer of flagged content and what was taken down.
                                    • No search terms or marketing partners give the illusion that the content they are marketing will contain child exploitation materials or depictions of non-consensual activity.


                                    Paysites
                                    • Website must have a complaint process for reporting, review, and removal of such content.
                                    • Take down requests/flagged content will need to be reported monthly to the acquirer.
                                    • Have policies in place to make sure that the website cannot be used for human trafficking.

                                      A lot of amateur models and couples will not want their info "out there". I imagine the amount of user uploaded stuff will decrease now.

                                      Tubes will need to rely on their Content Partners more now.

                                        You should double-check with your processor. See if they can send you the actual revised standards by MC. I've a copy of them and for live streaming, it isn't as harsh as some make it out to be (no, you don't need staff to literally be watching each and every stream in real time).

                                          A friend of mine owned and operated the best cams site for the PI. He told me once his wife and a couple of friends had to watch hours of tapes daily due to the cam girls bringing in; unsigned girls, animals, kids, into their shows. Kids were not part of the show but they were sometimes in frame.

                                          It probably depends on where your cam studio is but if you want to be sure, you might need to be diligent. 5-10 years ago this guy was killing it. He knew what he was talking about.
