Heres your argument...So, what exactly do we mean by “obscene”? The Supreme Court defines it as any material which "appeals to a prurient interest in sex, portrays sexual conduct in a patently offensive way," and which "does not have any serious literary, artistic, political, or scientific value." Taken at face value, then, art—by definition—could never be obscene, and that would be the end of our discussion!Comment

I don't have any issues supporting Supreme Court rulings, which strongly excuse erotic sexual art from being considered "obscene", but I would feel much better about using Paypal as a processor based on first-hand long-term experiences by those who are already successfully doing this (not simply "getting way with it"), and it would be even better to find a TOS statement from Paypal which specifically acknowledges erotic art as being exempt from the legal definitions/rulings on "obscenity".
There are literary publishers who actually include a breakout section in their TOS to clearly define specific types of erotica and what they permit, don't permit, and what they advise against in terms of content.
So are there any Paypal vendors of erotic art that have been doing it successfully with Paypal's explicit consent?
What further complicates things is that unlike Canada, where the Criminal Code is Federal, state laws have varying interpretations and tolerances regarding sexual content.
Shipping erotic art to the US is another hurdle.Comment

Bottom line...
* Only US-transactions (not sure if this means US destinations or US-source-and-destinations).
* No digitally transmitted content, although sending a flashdrive or DVD-ROM with content seems permissible.
* They "consider" the literary, artistic, political, or scientific value of the product.
This seems to leave more room to work with although Paypal does have a long history of surprising merchants with frozen accounts and permanent account deletions without warning. They have also bullied Patreon to de-sexualize their account portfolios in the past.
I know many adult biz folks are using Paypal for B2B, but even being paid for explicit graphic design/artwork or copy writing/authoring of sexual site reviews (which is transmitted as digital content) is pushing the limits of their TOS.
