Hmmm... it's still a name, though. It's not like something she made up and copyrighted... or is it?

I must agree with all that is said about APIC. If they wish for you to follow the legal procedure, then they should, as well.

I was using some of oliver's pics without knowing. I had grabbed them off of other pages (i.e. the so called 'public domain' ), and he emailed me, told me that I was doing this, and was polite about it, and it was cool.

I had absolutely no problem with taking his pictures down. I'm sure if the most hard core picture theif who refuses to remove pics unless properly notified by the owners of the copyrighted pics had recieved the same email, they would have complied, as well. In fact, he didn't even ask me to remove the pics, he just asked me to link back to him, and gave me permission to use them.

Now, why can't everyone be that nice? I agree that some people are assholes, and I don't care how APIC treats 'em. I have reported a few people myself who are just plain ignorant. But I agree that if they approached people better, they would have less people bitching at them, and they would be in a much better position having people liking them, rather than people who hate them.

Madonna is her real name, don't ask me how I know, I've never been a fan.

The fact that when asked, "Who is Madonna?" , some say the pop star means nothing. More people in this world would probably respond.."mother of christ" right or am I totally off. I don't know, I'm not a christian, but I find it hard to believe that she is more well known the mother of Jesus Christ.

So if that is true, it is different than Britany Spears or Limp Bizkit. Someone out there may have a desire to make a site devoted to Madonna the religious figure not the pop figure. That is probably why, I believe unless things have changed, she lost her fight whereas Pamela Anderson and others have won theirs.

Man, I'm POSITIVE some famous star that is famous with a single name alone (i.e. no last name), sued someone and got their .com of their name. I was sure it was madonna. But the madonna.com doesn't go to her site... Can anyone enlighten me?

yes, I thought it was madonna. And I was under the impression that she had won as a result of it. This would be a big thing, because her name is not made up, and it existed before, BUT because of her popularity, most people think of her when they hear 'madonna' just as most people think of a certain girl when they hear 'britney' or 'britnet spears', even though in this case, her name is more common. But since the .com does not point to her official website, I am not sure what happened. It seems to me that you cannot copyright the name, and therefore there is nothing wrong with using a personal name on your site. It's not like putting 'playmate' in your tags, in which playboy created and owns the copyright to that. No one can copyright britney.

hey pete dog, what celebs does lin milano protect.

anyways, with the alyssa milano case, according to a special I saw on E!, which was about 2 years ago(saw it again more recently though), people have the rights to post pics of celebrities nude (back then). Just like they have the rights to post pics of celebrities clothed, invade their property, or spread rumors about them.

I don't know if that law has changed, but why is truecelebs and all of them still running. Do you think that they own copyrights to that material. Of course not.

But anyways, if you have a name like britney spears on your adult site, you could definately get some heat for that. As far as legality, I can assure you it's legal, as long as the britney spears text link doesn't lead to a britney spears nude pic.

BTW, girls gone wild is completey different.

I know everyone says there's no such thing as a public domain, but ggw has expressed permission to sell these vids because they aren't on a public domain, but rather a private domain. If you go to mardi gras, (well I haven't), but my guess is that there are warning signs that point out that anything herein caugth on video tape can be distributed. I know that's how they did it with the spring break ggw tape. GGW filmed on of their spring breaks on a private area, and there were legal disclaimers all over the place the specifically said that anything caught on tape can be distributed to the public.

I think you are right about the girlsgonewild.com they use it because no one is going to sue them, regular people don't have the time and money. If they don't want people to see their tits they keep their shirts on.

oh yeah, if I got e-mails from lin milano, I'd just laugh. Even if she does sue you, you could just sell the story to publicists for hundreds of thousands of dollars, lol.

And you'd also probably get to meet her daughter big plus.

                        Anyways, what's her e-mail address?

                          MattressKing,

so you are saying that using celeb pics may be legal? and using their names may be legal as well? just as long as you do not commit dafamation?

if you read lin's legal stuff on the previous page. it appears to only have strength if damages occured. did you notice that?

according to the E! special, the webmasters were in legal guidelines, but I wouldn't fuck around with any of lin milano's clients either

Yeah, I doubt her daughter would hook up with you, but even she makes fun of her mother.
