Repeat Infringer Policy. As part of our repeat-infringement policy, any user for whose MATERIAL we receive three good-faith and effective complaints within any contiguous three-month period will have his grant of use of the Websites terminated.

Although we are not subject to United States law, we voluntarily comply with the Digital Millennium Copyright Act. Pursuant to Title 17, Section 512(c)(2) of the United States Code, if you believe that any of your copyrighted material is being infringed on the Website, we have designated an agent to receive notifications of claimed copyright infringement. Notifications should be e-mailed to [email protected] or sent to:

All notifications not relevant to us or ineffective under the law will receive no response or action thereupon. An effective notification of claimed infringement must be a written communication to our agent that includes substantially the following:

(b) Identification of the material that is believed to be infringing and its location. Please describe the material and provide a URL or any other pertinent information that will allow us to locate the material on the Website;

(c) Information that will allow us to contact you, including your address, telephone number and, if available, your e-mail address;

(d) A statement that you have a good faith belief that the use of the material complained of is not authorized by you, your agent or the law;

(f) A physical or electronic signature from the copyright holder or an authorized representative.
I sent a notice to [email protected] but have not seen any thing removed.

I then noticed it says this below

Does this mean I need to send a letter in the mail?

Yes, but you have to make sure that you send the valid notice that includes:
(a) Identification of the copyrighted work that is believed to be infringed. Please describe the work and, where possible, include a copy or the location (e.g., a URL) of an authorized version of the work;
(b) Identification of the material that is believed to be infringing and its location. Please describe the material and provide a URL or any other pertinent information that will allow us to locate the material on the Website;
(c) Information that will allow us to contact you, including your address, telephone number and, if available, your e-mail address;
(d) A statement that you have a good faith belief that the use of the material complained of is not authorized by you, your agent or the law;
(e) A statement that the information in the notification is accurate and that under penalty of perjury that you are the owner or are authorized to act on behalf of the owner of the work that is allegedly infringed; and
(f) A physical or electronic signature from the copyright holder or an authorized representative.

Yes, you will need to mail a physical letter. Another good idea is to CC the company's host on your DMCA request. That's what it took for us to finally get our content removed from GirlsReleased.com

I've not had any issues getting content removed from SpankBang submitting DMCA notices via e-mail.

I use the same email for all my dmca removal request. Just replace the links. And i always try to cc the hot and their abuse/dmca email. Spankbang has been consistent with all my removal request. about 3 days from notice to removal. the problem is that you have to put them on your watchlist. Can anyone advise a good software that tracks your content on the net? I heard of a couple but would like to hear from the experts.

We too have been submitting Notices for content removal to SpankBang and they are usually taken down within hours of our sending them... also, if you have sent three or more separate Notices that were for content uploaded by the same account then you can request them to take action based on their "Three Strikes" policy. You'll need to send them those links again in that request so you'll have to keep track...

They will no longer delete accounts as a result of their "three strikes" policy but they WILL prevent that person from uploading any further videos. It's not a perfect solution but it does help.

I've been having trouble with SpankBang lately. Back in March or so I found a video of mine on there, sent them an email that wasn't even well worded, just a casual [such and such] is mine. They took it down within an hour.

Recently I've found a whole bunch more of my stuff on there and I've sent several emails in the last 10 days or so, doing my best to conform exactly to their rules and nothing. No reply, no takedown, no explanation of what I need to do differently.

They are still unresponsive to the stolen videos we sent DMCA's for.
It's really frustrating to see them resell stolen cam shows to Jasmin.

If someone can help us with this, we would appreciate this.

Go to the host and then threaten them with RICO statues, works for me every time...

This is the language I use:

Quote:
......I am pretty sure that you are aware of these illegal activities, but

if you are NOT, then consider this also as a notice of these facts

as all participants may be charged and convicted under RICO

statutes. Specifically section 2318 (relating to trafficking in

counterfeit copies of motion pictures or other audiovisual works)

and section 2319 (relating to criminal infringement of a copyright).

Since money are changing hands maybe also under section 1960

(relating to illegal money transmitters). We may also notify Visa

and MC of "this run around" because SOMEBODY is paying this thief....
