From receiver part, there is no penalty for using those, and that will not hurt deliverability in any way.

From sender part, you in this case, read terms and conditions of the email service you are using.

You can send what you want; you will only have problems if your emails generate excessive complaints so make sure you are doing regular list maintenance, removing inactive addresses and responding quick to unsub requests.

Also, if you are linking to hosted images they will usually be blocked by default on most email clients...and if you are embedding them into the email messages then make sure you have a good bandwidth plan.

If the user subscribed via double opt-in and you comply with all the stuff about unsubscribe etc, yes.
