                                                          Amazing restraint. He recognized the fact they were both backing off once the gun came out. No longer an imminent threat.

                                                          It's a very fine legal line these days. Had he followed through and shot while they were walking/running away, I can see a prosecutor making a case for unjustified shooting as he was (arguably) no longer in direct danger. I say "arguably".
