Is SoBeGirl a man of his word?

I don't know how you do business. But when I give someone XX amount of money in exchange for specific products or services, I don't expect them to turn around after I've made a purchase and tell me that they have changed their mind about precisely what it is that I'm buying. Where I am from, that is called "fraud". As for a refund, I have asked repeatedly for a refund and so far he has ignored the request.

As soon as you create your work, a copyright is created. When a photographer clicks the shutter, s/he has a copyright in the image that appears on the film. When a designer creates a promotional piece, when a painter paints a canvas or an illustrator sketches an image, a copyright exists as soon as the creator's (non-copyrightable) idea is expressed in a medium that can be viewed.

I haven't gone through the entire thread yet, but in defense of SoBeGirl, I've sat next to him and his girl at a webmaster dinner and he seemed liked a straight shooter, with a lot of ambition and energy, and ideas. I've never seen his studio setup in South Beach, but I've not heard anything bad from other photographers down here in South Florida about him.

I had a studio in LA before so I know the dilema photographers are in by handing out there complete model info. A handful of webmasters are slick willys and will turn around, setup a small content operation and start reselling the stuff.

I had one large collection of chromes I bought once and ending up having 2 other photographers call me when they were in the magazines saying I didn't have a license. Yet I had it in black and white along with the signed model releases, and double ID pics. So 3 photographers say they own the rights. Two were lying or somebody fucked somebody over there.

This is why content creators get so paranoid about handing out the works to webmasterss. It basically is like handing over the printing plates at the Federal Reserve. Once you have it all you can print your own dough.

Just my 2 cents for what its worth on this thread. I understand the webmasters dilema as well in light of all the stringent regs out there. Its a tough call.

Sobe, just give the docs man even if you think it does not comply with the law Aaron has stated. Even if you think it is not law, think of it as Family law for the family. Just do it bro.

Aaron is who we have put in charge of getting detailed law legalities when it comes to content. The family has invested serious money in educating him and giving him the oppertunity to consult with some of the finest legal advisiors and attorneys in the nation representing our industry. Sure many may not agree with it and say its bullshit and its not law, but as a family we like to cover our ass and that of the webmasters so we make it official family law.

Aaron is the say and I am confident he is not making it up. You may see or feel otherwise which is your right. But consider this family law. Please comply thats all bro.

I dont expect the two of you to get along since there was a lot of personal attacks here. I can only hope you two get along in the long run and we can have some beers together in Florida as a family.

This would not be the first time Aaron has shown tough love initally, just ask Paul Markham. But in the end im sure you will find it is in your best intrest to work with aaron on this and not against it. He can be a very valuable friend and is only sharing this info to protect us all

The easiest way to protect copyright is to have your name and contact details in the documents. Then if any one tries to resell them the buyer knows exactly where they came from.

Assuming the purchaser insists on the documents.

I asked about a legal copyright. One that actually give the owner "RIGHTS" in a court of law and what you have just described does not.

Thanks Boneprone. But Sobe is not the kind of person I want to do business with. His word obviously means nothing. I want him to send me a refund via Paypal. I have asked for this countless times, but he ignores my requests.
