It wouldn't surprise me if he thinks this should be retroactive legislation. I'm not saying he would know what retroactive means, but he'll probably want to eject every citizen born to immigrants in the last 100 years.

Anybody inside the U.S. borders, other than diplomats, are subject to the jurisdiction of the United States.

If an undocumented alien were not subject to the jurisdiction of the United States then they could NOT be arrested or deported for entering illegally.

The 14th amendment was passed in 1868 in response to Southern States "Black Codes" after the civil war. The "Black Codes" were state laws that kept black people from being totally free.

It was an amendment to the Constitution to ensure that all slaves in the U.S. and all their children were to be citizens.

It was never meant for ILLEGAL aliens to walk across the border and drop a kid out of their womb and be a "citizen" and then have the whole family brought in as part of "chain migration".

People these days are so uneducated about the Constitution and it's origins and meanings.

"Birthright Citizenship" isn't a part of the Constitution. And the reason that the amendment says "subject to the jurisdiction off the United States" is because it wanted to cover ALL former slaves...including slaves who were recently brought to the United States.

It's actually an amendment that should be repealed...much the way the 18th amendment was repealed by the 21st amendment.

There is no more need for slaves to be given citizenship. That is the distant past.
Politicians used that amendment in modern times to give citizenship to their ambassadors who had children abroad by proclaiming that the Embassy in a foreign country was "U.S. soil" (even though it legally isn't).

And most recently it has been used politically in the whole immigration debate.

What Trump is doing is pretty obvious.
He is going to do the Executive Order.
That will IMMEDIATELY trigger a liberal Judge to stop it.

Then it will go to the Supreme Court.
Then "Birthright Citizenship" will be ruled to be un-Constitutional.

Then it would be up to Congress to amend the Constitution to allow illegal immigrants to walk across the border and give birth to a new U.S. citizen...or not.

Who we vote for in Congress and the Senate is very important in these matters.

Whichever side of the debate you are on (and the Democrats until the last few years were ANTI-Illegal-Immigration)...you need to vote for the politicians who will do what you want them to do.

I'm fine with changing this law. In fact, I have said multiple times I would rather they focus on changing this law and going after people who hire illegals than to waste money on a wall.

That said, it scares me that any president, much less this one, could potentially modify the Constitution with a EO.

I would rather see him engage congress and try to do it that way.

I was under the impression libertarians believe in free immigration and don't want the government to waste resources interfering with it.

is that no longer the case?

I'm fine with changing this constitutional amendment as well

But not illegally via executive order.

And with the caveat that we give a pathway to citenzship for current illegals on our soil that have lived here for 10 years or more.

relax, you're the last person I'd worry about. the simple fact is you've claimed plenty of times you are a libertarian and it's a fact that the Libertarian party platform believes in free immigration, I researched it when I was contemplating libertarianism. He can't "modify the Constitution". That's already been done many, many times by lawmakers both Federal and State and Local.

Just look at "gun laws" for instance. The Constitution pretty plainly says the right to bear arms "shall not be infringed".
And yet the govt. does just that.

That is an amendment that should either be followed (as is the law and intent of the founders) OR...repealed and replaced.

In the case of "birthright citizenship" (which doesn't really exist), as I so brilliantly explained in my post above...Trump is doing this to trigger a Judge to issue some kind of injunction.
THEN it will go through the legal processes and go to the Supreme Court and the whole idea of ILLEGAL ALIENS giving birth to citizens will be ruled on once and for all.

It's pure genius by Trump. This matter has needed to be looked at by the Supreme Court for over a hundred years since politicians have been changing the meaning of it.

So please don't be afraid. You can be brave and know that the President has a plan to stop the Democrat Party from creating a new voting block of ILLEGAL ALIENS (by the way, San Francisco is allowing ILLEGAL ALIENS to VOTE in the local election for school boards...non-citizens voting in the United States...wow)

I said I'm a Libertarian because the majority of their views on freedom fit in with mine. Doesn't mean I am a group thinker. Hell, I don't even give a shit what other people think about much of anything.
I consider it...use my own brain to make my decision based on what I know and learn about subjects and move from there.

I understand he isn't modifying the Constitution and I understand there are many laws on the books that do just that. I personally wouldn't trust Trump to mow my lawn so, no, I don't trust him to sign EO's that involve things that are spoken of in the Constitution.

I do think this is something that needs to happen, I would just like to see him, oh, I don't know, maybe lead on something and try to work with congress.

if i lived in central ca i could maybe see what you're saying. why pay cali prices to live in shithole central cali? socal is a different place and worth the price of admission.

I live by the beach here in South Orange County, 11 years now. I walk my dog on the path along the Monarch Beach Golf Course to the beach every morning. Cool breezes here when it's 120 degrees in Vegas. I move sometime in the next few years maybe back to Australia and Beach living there.
