				2257 and video thumbnails

If I embed a video from a site such as Pornhub (or any other adult video site that supports embedding) and the video thumbnail shows explicit sex - do I need to keep the 2257 documents, or does the site hosting the video need to keep those records?

			Any information is appreciated. Andy

All this really might depend on FSC's 2257 case that's ongoing. I'm not a lawyer or 2257 expert, but *FROM WHAT I UNDERSTAND* it used to be where secondary producers didn't have to worry about 2257, but there was some law that passed that got rid of that precedent and *TECHNICALLY* secondary producers should be 2257 complaint.

Weird how none of this applies to "search engines" and since every site has a search function, why aren't they "search engines"?

This is the one thing that had me scratching my head over the passing of SESTA/FOSTA, as it got rid of a bunch of those Safe Harbor provisions, which *TO THE BEST OF MY KNOWLEDGE* is what was protecting search engines, sites running on UGC, and so on.

It would be really great if they would start to enforce these rules

Income would shift back to the people that are actually producing the content, and the small affiliates that can produce the traffic, like it was before tubes came along ![]()
