Why can PornHub process Visa/MasterCard for ANYTHING?

I don't get it... Visa/Mastercard have all these strict rules for things that aren't allowed to distribute through your site including sex with drunk or sleeping people, violence etc, payment processors want permanent access to your member section so they can monitor this... why are these rules not applied for Pornhub? Search for "sleeping", "drunk", "slapping" etc

And oddly enough, it was ruled this year that a pirate site can screen content and still have safe harbor, which is contradictory.

So Pornhub screening illegal content, but not legal content against Visa regs, seems a possible liability for them

Visa/Mastercard could easily require tubes to screen for content against their regs with this new ruling that happened in March

Did you know that if you have a tube site and no DMCA agent listed here that you have no safe harbor protection?

The trick is it goes to another domain (pornhubpremium.com)

so they don't process for pornhub.com but for pornhubpremium.com and on that domain they block all the videos/search/keywords that are not allowed by the acquirers/visa/mc (and they also block all videos that are obviously copyrighted and not from their content partners)

they also have this text to make it more compliant:

From what I know scat was never officially banned by Visa or Mastercard, just that most of the banks and processors don't want it.
But it isn't specifically mentioned in their rules like CP rape and bestiality are:

https://usa.visa.com/dam/VCOM/downlo...les-public.pdf

Quote:
A Member must not use the Visa-Owned Marks:
l In any manner that may bring the Visa-Owned Marks or Visa Inc. or its affiliates into disrepute
l In relation to, or for the purchase or trade of, photographs, video imagery, computer-generated images, cartoons, simulation, or any other media or activities including, but not limited to, any of the following:
– Childpornography
– Bestiality
– Rape(or any other non-consensual sexual behavior)
– Non-consensual mutilation of a person or bodypart
A Member that does not comply with these requirements will be subject to non-compliance assessments prescribed under the Global Brand Protection Program.

The sale of a product or service, including an image, which is patently offensive and lacks serious artistic value (such as, by way of example and not limitation, images of nonconsensual sexual behavior, sexual exploitation of a minor, nonconsensual mutilation of a person or body part, and bestiality), or any other material that the Corporation deems unacceptable to sell in connection with a Mark.
(Note the 'not limited to...' in both though, so it's not set in stone)

Correct, they don't get to see all the videos that are on pornhub.com

They filter out the stuff that is not allowed by the card schemes and (most) produced (non amateur) content that they don't have the rights for etc.

Ok, so all that stolen and "prohibited" content they have on pornhub.com is not on pornhubpremium.com? I didn't know that and never wanted to check if our content is there because I don't even want to pay a dollar to Pornhub to get entry.

It makes sense, "legally" we could do the same for our own content... think of some new domains names, put "prohibited" bait content on there and send those who click to our main domains.

Oh well the fun thing about user uploaded content is that we can upload content to Pornhub too, lately I see people uploading gay content and tagging it as straight, that must upset a lot of of the free skaters on there and not encouraging them to pull their credit cards :-)

They just care about risk. Probably at large enough volume they allow custom ways to mitigate risk

CC processing and (pseudo) rape is apparently OK in Japan. There's many a production company including big ones under the DMM umbrella (see Attackers and Cinemagic) that openly produce movies with overt rape themes. These are professionally shot, full production crew, storylines, etc, featuring top-ranked actresses, but do often have themes of duress, "aphrodisiac" usage, extreme BDSM, etc.

How do you think all these fake pills process with Visa/Mastercard with 10%+ chargeback ratios?

They have bunch of merchant accounts, and keep going and going.

Pornhub is pretty 'safe' and has a low chargeback ratio.

That's what really matter.

I asked to reinstate my cc processing for a mainstream project I’m working on. They’d closed my account after a year of no usage. They went back ten years, saw I had adult but non-sexual processing, and said they’d need to see the site. It’s not built but they claim to need ftp access when done to be sure no adult content is there. I could store it elsewhere, of course, and give the link on sign up. But it’s mainstream only and they’re not taking chances.

I assumed the tubes processed overseas. All the pro scenes I’ve seen – and I’ve only visited a few times- link to the paysite.

PornHub now also shows scat content. Just search for "messy anal" etc. I still don't get it, as far as I know Epoch processes for PornHub and we had a clip with messy anal on our website they made a huge fuzz about it. But if someone uploads that same clip to PornHub then suddenly it's totally ok for Epoch. Does Epoch simply have a problem with honest people selling the content they actually own legally?

It's probably not profitable for them.

They probably make more money on mega tube sites with all the stolen content then hundreds of legit content creators.

Some day they'll come begging for our business when the law turns the tables on them. I've never been treated worse by a company when contacting them to do business years ago.

Ok, so I should check whether the messy anal content is also present in the premium part of the site. I will do that. Thanks.
