I don't think the judge will like him too much after that. If he denies it, a simple blood test would to the trick. He's smoked every day for 6 months straight (is stoned tonight, at his "new place" actually).

A small claims court judge can't subject someone to a blood test to check for drugs. Doesn't work that way.

Only thing that matters is who the judge believes more. Remember all those friends he had over everyday? You can bet your ass they'll be there in court to back up his story.

Get over yourself and let it fucking go.

Yes, he can be a non-compliant room mate and be an asshole about things and not compromise and have people over 24/7. There's no legal ways for me to stop him. This got childish and I had to tell him not to touch any of my shit (mentioned in first post). Oddly enough after I did this, his friends stopped coming over. Finally we came to an agreement, which he DID NOT abide by, and now he'll suffer the consequences.

As far as smoking pot in the apartment. His girlfriend informed me, and two of his friends that smoked with him here informed me. I have my girlfriend as a witness to his girlfriend informing us, and a logged Trillian/AIM conversation of one of his friends informing me. Not to mention, he's yet to deny it. He just says "whatever you weren't here, we cleaned up the smell". He's a complete idiot, and should be treated like one.

Well in most situations that'd hold true. But when you have legal agreements to tie somebody down, it's not true. I have complete control over this kid. If he wants to take it to extremes it'll be 1) small claims court in which he's forced to pay 2) drug screening at his work in which he'd fail (Best Buy) 3) police visits to his house

I don't plan on doing either of the two latter, but when you get right down to it I'm doing nothing legally wrong and he's doing everything legally wrong. I can do whatever I want to him at this point, and he has no say so in that (well he does, he can just agree to pay another month's rent and we can hopefully sell this place).

The stupid bitch stole, owed me mega money, trashed my house...but i sucked it up on my own stupidity of letting the ho live at my house..so i left a message on my answering machine that the girl had left her x-mas present at the house and she needed to pick it up.. i waited in the dark house with my gun loaded..when that bitch opened the door i hit her as hard as i could with the butt , knocked her right back out the door and down a few stairs and let her know if i ever see her again i would kill her stupid ass for fucking with me. her being the stupid bitch that she was brought along some man power ..hahahahaha.. they were pussys too...whining for me to put the gun down and to let this crazy bitch in my house to steal from me some more.. it took about two shots to the ground right beside their feet to let them know how serious i was, meanwhile the btich is screaming that if i shoot her she is going to call the police...i told her if i shoot her, she will not live to make any phoen calls.....she left town..never to be seen from again...then i called the police and told them that if she is on my property again i would not hesitate to use proper force to remove her ass.....this was all in the great state of Texas..where if you let the police know you warned someone not to come on your property, u can shoot them for trespassing (dont know if its still a law or not)

Here's what it comes down to, from my experience. Unless you are owed $2000 or more, dont bother with small claims court. Stand up to bad roommantes right away. Once you let shit slide for a few months, you'll never restore order.

I had a roomie who smoked pot in the house. I told him twice not to, but he kept doing it. I told him I would call the cops next time he did. He smoked again, I called them. He flushed $400 worth of pot down the toilet when they knowcked on the door. But forgot the stash in his bedroom. Cops hauled his loser ass away. Thats the only way. For this story, call cops to get your stuff back, but forget court or all that shit. Chances are you wouldn;t win anyway, no matter what he signed. Its all hearsay.

Chalk up the losses to learning experience, and set the rules and enforce them from now on. I have nothing against pot, just dont want it in my house. You seem to feel the same way, so refuse any roommate that does pot.

By signing that, he agreed, and that's what the courts looked at. On a side note, mentioning his drug habits in a formal court wouldn't exactly make the judge drop to his knees to give the kid a BJ. You would think so, wouldn't you? Unfortunately, even with a signed lease, the violations you claim are hearsay, unless a police report was filed. You can tell the judge he smoked pot, but he can tell the judge you were worshipping Satan and sodomizing sheep. Judge isn't going to submit him to a drug test any more that he's going to ask a local sheep to take a rape kit test. Small claims court does not work that way. Take my word for it. Only way you win in small claims is with a police report, a bounced check, or a traceable good (like your stereo). Anything else, the judge has no way of telling who is lying, so he'll just assume everyone is lying, and go off the written record.

Well fortunately he already realized he was screwed. We're meeting Thursday and he's giving back the stuff he took, as well as rent for next month up until we can sell the apartment.
