New Porn amendment voted today

Anybody know the outcome?
http://www.avn.com/articles/12067.html

WASHINGTON - How would you like to do two to four in the calaboose and pay a fine for using benign domain names to shanghai surfers - especially young surfers - to porn sites? If an amendment set for a March 27 vote in the U.S. House of Representatives becomes law, that's what you'll get for doing it.

The amendment was attached to an unrelated child-abduction bill. "A domain name that includes a word or words to indicate the sexual content of the site...is not misleading," the amendment's language says. And the amendment would include domains listed outside the United States. CNET.com says the amendment is expected to pass the full House easily.

A second amendment attached to the same bill would bring back Congress's bid to outlaw "virtual" child porn - images that look like children performing sexually but that didn't use actual children in their making. The Supreme Court struck down their first try on First Amendment grounds.

The domain name amendment was introduced by Rep. Mike Pence (R-Indiana), who has tried twice before to get similar legislation through Congress. The bill to which it was attached ran into some opposition when its author, House Judiciary Committee chairman Jim Sensenbrenner (R-Wisconsin) tried to broaden it to include sex tourism, wiretapping, and criminal penalties.

Here it is and passed by voice vote.

11:30 A.M. -

Amendment offered by Mr. Pence.

An amendment numbered 1 printed in House Report 108-48 to make it a criminal act to knowingly use a misleading domain name with the intent to deceive a person into viewing obscenity on the Internet. The amendment also makes it a criminal act to knowingly use a misleading domain name with the intent to deceive a minor into viewing material on the Internet that is harmful to minors. A domain name that includes a word or words to indicate the sexual content of the site is not considered misleading.

I agree with the idea in principle, but the devil is in the details.

If you have sites that use shit like donald duck, or mispellings of nickelodeon and redirect that to porn.....that's pretty bad.
But I wonder if you'll HAVE to have a sexual term in your domain to stay out of trouble. Last I checked thehun, shemp, persiankitty, al4a, etc etc didn't have any adult terms in the domain name.

If they can show "intent" to deceive, I have no objection. A domain with a name like MrRogersFunHouse.com should not be a hardcore porn site.

I dont think they are going to review every domain name unless you have a really obvious one like white house or freecandy. It just gives them another tool to go after us with. They want you and cant find another reason ,they say can his name.

I was surprised by that also. I figured there would have been tons of responds because of the issue domain names.

Most of us here own our own domain names, run them thru tgp's all day long, they are high on se's and easy to be found..

Oh well, nobody seems to really care until they hear a knock on their door saying

"Sorry your domain name peddles porn to kids, youre going to jail"

Maybe I am just weird!
Oh wait,,, I AM WEIRD

Has this actually been passed yet? I don't think it has. Besides, the domain name issue has nothing to do with the rest of the stuff in 1104. Including no statute of limitations for sex crimes involving a minor, a 2 strikes and your out law, and others.....

But if the domain name thing ever does become a law, it's probably a good thing. Sites like WhiteHouse.com help give online porn a bad name. This is the equivalent of Hustler hiding their magazine inside a Sports Illustrated cover. Deception is clearly the primary marketing strategy for the owners of WhiteHouse.com. They don't even bother to put up a warning page even though most of their visitors are likely looking for WhiteHouse.gov.

Using the MrRogersFunHouse logic I could say that girlsdotcom.com shouldn't be an adult site, my teenage daughter typed that in thinking it would be a site for girls with make up tips and stuff like that. (I'm reaching I know, but still I have a point)

Plus look at all of the keywords people frequently use to find our sites that "technically" aren't sexual in nature
black, ebony, latina, teen, etc etc

I agree , alot of people fall in the it wont happen to me crowd. people have been irresponsible chasing the almighty dollar not thinking of what can happen. Thats why I say when one webmaster does something fucked up it affects us all. If they go after whitehouse.com first. I assume they do well and have deeper pockets than most. So how they do ,will set the tone because I looked at their site and didnt see anything that could be though luring kids in .

Don't panic yet. Its still has to go through the Senate and then get signed into law. The senate might take it out knowing it could mess up other parts of the bill for what it was originally intended the Amber Alert law.

And then the ACLU will jump all over it.

Whenever they add that word knowingly it opens up a can of worms also.

This is the exact wording of Rep. Pence's Amendment.
It reminds me of the laws about obscenity.
So now you can see exactly what it said.

This reminds me of back in the days of goto.com's ppc -- I was arguing with some Aussie bitch that worked there about whether or not "cheerleader upskirts" was an adult term. In what context could it be used that does not imply adult meaning?

She insisted that I have a sexual word in my keywords, so I finally got pissed off and said "How about 'Australian C U N T chokes on DOG SPERM while viewing CHEERLEADER UPSKIRTS' -- is that BETTER???"

sleepingbeauty.com used to be a pornsite, they scaled it down a lot. however it probably still gets a shitload of type ins.
I actually typed it in myself once because me kid did something in school about Sleeping Beauty the book.

I read that pdf file. I think I just crinch of the thought of them censoring some of the sites I have. Not misleading but still not for kids either.

Ethnicteens.whatever?
stuff like that...

First Visa censores what we can bill in the US
Than the Senate censores what we can use for domain names
The US Postoffice censores what we can send (Adult)

Whats next?

I guess we go and start looking for the .sex domains now..

And nobody will ever know or care right now. We are at war, you think anybody gives a darn whats going on everywhere else. Just look at the responses. There are more threats about the War in Iraq than on an issue what concerns us all on this board.

I need a drink..

They have got to be making millions on that site...

and you wondered why I am shopping / seriously considering other countries to reside in?

If I'm going to loose many of the freedoms that made America great, and get taxed more and more every year, I might as well live in a country where it is expected and where the USD goes a lot further ;)

S. America and other parts of the world are sounding more and more appealing by the week as of late...

very good point and I agree for the most part, until we start chopping up the 1st Amendment issues...then it all goes grey again...
