That's the problem, they never gave me any info. I didn't even know which gallery URL was infringing. I asked for a copy of the DMCA report many times but never received one.
Yes, i did get owned. By fucking thieves.
I hope other people don't make same mistake. Because by their logic (and terms) even using a MrSkin banner to promote their site is grounds for account termination for "trademark infringement". (when it suits them)
And if by site you mean the gallery, i guess it does suck, it been made 10 years ago or so.
They gave you the name of the complainant, the original copyright holder. Why don't you contact the photographer whose work you used without permission and, unlike Mr. Skin, without promoting him?Comment

Two quick thoughtsMore lies from Mrshitskin scumbags.
You told me it was a DMCA report. Here's a screenshot. (and after numerous requests you never showed me a copy of it.

I didn't insinuate anything. Any webmaster promoting celebrity niche is using celebrity photos from various sources from the internet. Everyone knows this. You didn't have problems with it for years while i was sending traffic your way. And you don't have problems with obviously dubious content on high traffic websites and tubes when you spam them to promote you. I already posted a photo of you soliciting it.
So you are "borrowing" someone else's work/content to promote your website. How is it any different from what i did? Double standard hypocrites.
Of course i was using your "trademarks" to promote YOUR program EXCLUSIVELY. That's the whole point, to make a gallery look similar to the paysite that you promote. What planet are you from?
Again, this only became a problem when i stopped sending you traffic. You didn't give a shit about this for years. And the domains had exclusively MrSkn galleries, which promote only your website. Terminating an account because of that is stupid. You could have just asked to transfer the domain (which we did same day after your requested it).
You aslo gave false hope (hinted) that transferring the domains to you would solve account lock problem. And after i promtly pushed the domains same day you just left me standing with my dick in my hand:

How could I remove all content? I have hundreds of galleries built over the years. I removed the one with the name mentioned. I couldn't remove the other one because i didn't know what it was. I asked you numerous times to send me the copy of DMCA report so that i would know the URL and which content exactly was in violation. Every request got conveniently ignored by you. You weren;t interested in fixing anything, just wanted a reason to can the account and keep the rebills.
I used your promo tools to exclusively promote YOUR FUCKING SITE, FOR YOUR PROFIT.
I removed the only instance of the mentioned celeb name i was able to find the moment i received your first email. You never even mentioned an infringing URL until in this thread. I asked for a copy of DMCA to know better what to look for, so that i could remove it. I cooperated fully and pushed the domains to you the same day. I promty did EVERYTHING to rectify the problem. You just werent interested in rectifying it.
Hopefully people make a good note on your "policies" and how you are able to terminate an account and keep all the money with any made up reason. Nice Terms & Conditions you have to fully protect yourself in any situation and fuck over any affiliate at a drop of a hat.
God damn scumbags
1. You should be able to remove content on all URLs. You should know what is on every URL of your sites. It is called doing business and being responsible. If you don't know what is on every URL on your sites you should take a little time to go through your server and document this stuff so you do know. Ignorance is not an excuse.
2. You rail against them being dishonest, yet you are knowingly using content you don't own and admitting to doing so. That makes you a thief. Maybe take a minute to look in the mirror before you start talking shit about other people.Comment

1. I have THOUSANDS of galleries from the TGP days. If they don't even tell me the URL, I can't know where the problem is. When someone sends you a DMCA report, one of the requirements is to describe which work is in violation and where it is located. Skin never showed me the complaint (i wonder if it even exists). Two quick thoughts

Why should I contact anyone? I'm not violating any copyrights as far as i know. I never received any notifications. Just because Skin says so doesn't make it true. Why wouldn't skin show me that notification?
Oh, this is comedy gold. Now Skin is promoting him? The copyright holder? In what way?
Do you just make shit up on the go, no matter how dumb it sounds, just to support Skin? Did they buy you a drink at one of the conventions?

I won't comment on what they have or have not given you and just take your word that you didn't know what content they were speaking of. That said, They did provide a URL in their reply and, well, you still have illegal content on there as of my typing this.1. I have THOUSANDS of galleries from the TGP days. The difference between what you are doing and what they are doing is simple. It is called Fair Use. You see you are taking content you do not own in order to make money. You haven't changed it in any way or done anything that would alter it from it original format (other than maybe size and compression ratio etc.). Mr. Skin provide commentary and reviews about the movies, the scenes, and the people in them. When they do this it creates a fair use situation. Imagine it like this: If you have TV show like At the Movies where you review movies and play clips from them. You are allowed to show those clips because you are also providing a review of the movie, hence, fair use. If you just took those clips and uploaded them to YouTube or some site you likely would be hit with a complaint.
If Mr. Skin were really breaking the law do you not think a big, powerful movie studio would have hammered them into the ground by now? It s a big site, that has even been mentioned in some movies and the owner goes on major radio shows like Howard Stern to promote it. If they were breaking the law they would have had their asses handed to them a long time ago.
The odds are they hadn't really paid much attention to you as an affiliate until you had lawyers contacting them about your sites. Had that not happened I have a feeling your account would still be open and everything would be fine.
This is the game you play when you decide to make money using stolen content. At some point that money might go away.Comment
-
Did you shoot the pictures?
Did you pay someone a licensing fee for the pictures?
Did you get permission to use the pictures?
Unless you answered yes to one of those you are violating the copyright on every one of those pictures.Comment
-
Yeah they did. In this thread. 3 weeks after terminating my account. And only because I created this thread. The conveniently ignore all my request to point out the content in question.
According to who? You? Or Skin, who also dont own the copyright? You can't pass that judgment. What if I had a deal with the photog and he let me use his content?
So they found a loophole in the law and are exploiting it. By same token I could write a line of text next to my gallery and claim it as fair use. But that still would be profiting from someone else's work. How is it any different from tubes who are also using stolen content and are hiding behind legal loopholes? The difference between what you are doing and what they are doing is simple. Can you answer yes to all these question regarding a photo in your sig?

Anyway, the legality of content or fair use is not the point of the thread. The point is that MrSkin will gladly take all your traffic, not matter how clean or dirty it is. But they will fuck you over when they are not profiting from it anymore (i.e., when you stop sending them traffic and just collecting rebills money). It's a question of affiliate program's integrity. The "celeb" niche in porn is and always has been shady. MrSkin is no exception. The affiliates promoting celeb content AND the sponsors are using content they don't own. That's the nature of the game.
It's pretty obvious what happened here. They were taking heat, decided to look through your account and realized that you were making money from rebills while sending very little new sales so they said fuck that... cancelled your account and will keep all the money to themselves. Pretty common practice in the industry.Comment

If you are posting modern photographs, without even knowing the source, you do know you are violating copyright. Why should I contact anyone? I'm not violating any copyrights as far as i know. I never received any notifications. Just because Skin says so doesn't make it true. Why wouldn't skin show me that notification?

Mr. Skin is presumably not promoting this photographer because his work does not appear on their site. I believe they do promote the work of people whose copyrighted material does appear on their site. Are you disagreeing with that?
You, on the other hand, are using that person's work and not promoting him. Mr. Skin has told you who the owner is, so why would you ask GFY where the images you took are, before you would ask the person with a lawyer where he thinks you are using his property? Do you disagree that your screenshots show Mr. Skin told you whose photos this is about?
What is confusing you here? Mr. Skin can't legally make money off of your illegal activity, which the complainant's attorney has notified them of. So you need to make good with the copyright holder, not complain to strangers on the internet about Mr. Skin.Comment

Yes, I am.
Here is just one of MrSkin's websites full of stolen, i mean "borrowed" content: Dakota Johnson Topless During Filming 'Fifty Shades Darker'
- they didn't pay for this content
- they didn't get permission to use that content
- they don't have a license to use this content
And they sure as hell aren't promoting anyone else but themselves.
Look, celebrity niche is tricky and hi-risk. I'm not trying to change anyone's mind here or set anyone straight. All i'm saying is that you can't trust MrSkin. Instead of working with together with you to solve things, they will jump at first opportunity to fuck you over and steal money from you.
I've learned the lesson and moved on elsewhere from their shitty, non-converting revshare program.Comment

That is not disagreeing with me at all. I made no assertion about Mr. Skin, other than that they told you where the complaint came from and they do give credit to their sources.
Mr. Skin can't work with you to solve you pissing off a copyright holder Mr. Skin has nothing to do with. You used content unrelated to Mr. Skin. They told you who the owner you have to satisfy is. Why would you give up domains and complain to GFY before contacting the owner of the photos to see what you could do to make it right?
If you can describe that the content is from Fifty Shades Darker, there is promotional credit.
Why are you scared to contact the actual owner of the work you posted and made money off of?Comment

You violating their trademark caused them problems with a copyright owner.
