    Tech New Federal Ruling: Warrant not necessary for police to hack your computer

    NORFOLK, Va. (AP) ? The search warrant investigators obtained before hacking a Newport News man?s computer during a child pornography sting was not only legal, authorities would have been within their rights to hack the computer without it, a federal judge ruled.

    Because computer hacking is commonplace and data about people?s online usage goes to internet providers already, 24-year-old Edward J. Matish did not have any ?reasonable expectation of privacy? to his home computer, the Daily Press of Newport News reported, citing last month?s ruling from U.S. District Judge Henry Coke Morgan Jr.

    In a ruling that is garnering interest in legal circles nationally, Morgan denied requests by Matish?s lawyers to suppress the evidence in the case, saying assertions that the warrant was overly broad are irrelevant.

    ?The Government must be allowed to utilize its own advanced technology to keep pace with our world?s ever-advancing technology and novel criminal methods,? Morgan wrote in his 58-page ruling on June 23.

      This is one of those times special passes need to be setup. Like warrants are needed however since cp was found..fuck you. To make up for it the cop who searched is fired with pension.

      So it is not a free for all..if searched and mothing is there...fired...no pension.

        I agree that in specific cases there should be leeway, like in this case they already knew this guy was evil, but the precedent now is everyone is a target by any corrupt local small town PD that decides to upload to your computer they can legally hack

          Bullshit.. if you give them leway, then they use that excuse for everything. Allowing leway just excuses sloppy and lazy police work.

                    Paul , for me it's not about that.

                    Remember how the cops used to always raid you and find nothing? Now they can legally raid your computer and there's no stopping them from planting evidence, that's my concern.

                    If Republicans get in power again and start another war on porn I could see this being abused and used to put pornographers in jail on trumped up charges with planted digital evidence.

                      That is a concern I didn't think about. Yes, it would have been easy for them to plant evidence. I agree.
