If I'm right, this means if they get DMCA for 3 videos from an account with dozens or hundreds of stolen videos: they will ban the account, all its videos and the IP, etc etc..

In my book this is a fucking awesome step!

This is probably causing legitimate uploaders [content owners] to gain more traffic to their videos/channels/sites. Which Is Sweet

Hopefully this is a Huge step towards the motherfuckers who are using xvideos to make money from stealing / rewatermarking content illegally, and at the same time bad news for CrakRevenue and similar programs who are the recommended money-making-machines on blackhatworld and such sites where these methods were popular.


"May 10, 2016 update : from now on, accounts that reached a total of 100 videos that were infringing copyrights will be banned (profile deleted, IP + email) and all their uploads deleted. We may apply this rule retroactively to certain accounts. Additionally, users that are found using multiple accounts may get banned at any time without any other reason.

3 strikes policy: at third strike a repeat infringer is banned.

Although we are not a United States company, and thus not subject to U.S. or Canadian law, we have adopted policies in an effort to voluntarily comply with anti-infringement laws such as the Digital Millennium Copyright Act ("DMCA") and the Copyright Modernization Act ("CMA"). Pursuant to such policies, we assert safe harbor for liability related to the alleged copyright infringement committed by third parties. This means that if an uploader has 3 videos deleted with a first notice he will not immediately be banned from xvideos; instead he will be given a chance to change his behavior, as this will count as 1 strike and not 3. Each notice is treated as a single notice for purposes of repeat infringement, regardless of the number of notices contained in a given notification. There would be little to no pedagogy in our repeat infringers policy if the process was to ban this user immediately. However, in certain circumstances, at our sole discretion, we may ban and delete a user after a single notice or two.

By your use of our Website, you thereby acknowledge and agree with our policy that you are a repeat copyright infringer upon our receipt of 3 or more notices of repeated alleged infringement, as defined above, where (i) the notices are directed towards materials that you have submitted for publication on the Website; (ii) the notices do not concern what We reasonably believe to be "fair use" of copyrightable material as determined within our discretion; and (iii) you have failed to, within 5 days after our forwarding the notice to you, provide us with a proper counter-notice that complies in every respect with the requirements set forth in Section 4 of our Terms of Service, thus permitting us to re-enable all of the materials cited in the original notice of alleged infringement.

Each such notice of repeated copyright infringement, as defined above on this page, for which you do not provide a valid counter-notice pursuant to the requirements set forth in Section 4 of our Terms of Service, shall be recorded against your user account. In the event that you accumulate three (3) such strikes, your account will be suspended, your email banned, and all your IP addresses blocked for 6 months (we cannot block them longer as IP's are used by legitimate users as well). Copyright-owners should provide a list of all infringing videos if they wish deleted. Users terminated for repeat infringement must not sign up for new accounts on our website."

That 3 strike policy was in place for some time now, only that 'total of 100 videos' part was added, but dunno how it worked before.. you could have like 1000 videos flagged at once and it would count only as 1 strike?

Sadly what I've noticed is people will merely change the name of the video and take out any information that is directly associated with the owners. Very hard to weed out unless you go through each video in detail.

Sadly the way the policy works is that the user has to be reported three separate times. On first reporting, they will go through the account and remove any suspected videos. Then report the user again if they re-upload or upload NEW infringing content. Rinse. Wash. Repeat.

I've reported accounts with dozens of infringing videos, listing all of the ones belonging to our program, and they left the account up with many other sponsors videos intact saying that the other sponsors need to contact them and that will still only be the first strike.

It's pretty useless.

Yeah people are already going through years of old videos - pretty soon there'll be no more fresh content. People are watching 320 X 180 vids looking for new faces and interesting situations. They've killed the 1000s of niche producers that made porn interesting. If they'd do a reasonable rev share, they'd have all the content they need, and lots of control. But no - only paid placement and hope for 1/5000 sales.
