eBay situation - your thoughts?

I will try and make this as quick as possible without going into every little detail.

I had someone buy an item from me off of eBay. Immediately after auction they sent payment.

Turns out this person did not read the auction correctly and thinks I owe him items he is not entitled to. Realizing this person is not being reasonable after several emails explaining to him what he is entitled to, I decided to refund his money (without him requesting a refund) so I don't have to deal with this headache.

He now claims my refund was not a refund but in fact a 'gift', and I still owe him items he is 'entitled to' since I am in a contractual agreement with him.

I figure, since he misread the auction, I should not be obligated to sell something to someone who thinks he is owed more then what he purchased.

To further complicate things, this guy then proceeds to threaten that he will sell items of mine on eBay (a script) that he claims is now '100% owned by him' since I had included it in the auction as a bonus - and that I should cease and disist selling my script now since I don't own it. (what a fucking crack head). He also threatens to file a lawsuit if I give him a negative at eBay for 'slander'. (he has only 30 feedbacks, no negs, gimme a break).

My last response from him was that I can 'buy back' what I sold to him for $10k (yet the item was $256).

I would love to introduce a louisville slugger to his wig but thats not very legal.

How would you handle this?

Don't tell me you're one of those sellers who sell Plasma TVs for $600 with very small fine print saying "This only tells you where to get it cheap"

The neg is most def coming his way.

What Im trying to do now is find a VeRO email template I once had. If you see someone on ebay infringing your rights (this guy now posted an auction using my ad copy), you can fill out the VeRO form and have someones auctions yanked - but I cant find them email and now I have to wait god knows how long for ebay support to send it to me. I wish they would just publish that crap on their site somewhere so I dont have to jump through a bunch of fucking hoops to get something done.

Exactly, this fucker is demented to the 9th degree. He has till 12am to comply to my conditions otherwise Im gonna get on his case. His auction will be cancelled for infringement, He will have his first neg on eBay, I will have RS unplug his server for website infringement, and I will contact the FBI and explain this fuckers illegal activities.

The nerve of some people.

you can sue him for less than $10K - if you're telling the true he'll back out once lawyers are involved and getting that started is only a couple of grand or less.

I know if someone provides a service to you that you did not request, then it is considered a gift by law. (at least in Canada).

This obviously doesn't apply in this case. The guy is fucked in the head if he thinks it does.

This guy probably gets his legal advice from newsgroups and thinks he can scare you into giving him what he wants.

whoa, this is just insane... i'd write him back w/ the most awful threatening wording i could come up w/, letting *him* know that you will sue him into oblivion if he tries to sell your script for his own profit, and that he has no claim whatsoever since his money was returned to him... how did you send him the money back, by the way..?
