The Supreme Court says you are wrong:

"...the US Supreme Court clearly recognized that they do have rights when it ruled that U.S. citizens may be designated as enemy combatants, but due process rights still apply to any U.S. citizens in detention. Yeah, I mean I wouldn't put it past the government to be capable of doing shady things like that. But I don't think that stuff happened in this case. But who knows more details might come out once Marquez lawyers up.
