Punishment for crimes are all about the person's INTENT. Thus, not all killings are equal with regards to the killer's mental state.
For example, if someone drives recklessly, and hits/kills a person...that is not murder. (It could be reckless homicide.) Because the person did not intend to kill anyone. So the punishment is less
Whereas a if a person kills another, with the intent to kill simply because the other person is black (or whatever race), then that is classical murder...with the added degree of hate for an entire race of people. So the punsihment is more.
So as you can see, punishment for killing another person is never equal across the board. The INTENT of the killer is a key factor in determining punishment.Comment
