It is a serious question.

I was wondering if Bill Gates decided he wanted to build a nuclear bomb, could he legally posess it?

and if not, what law prevents him from being in posession of a nuclear bomb?

The same law that prevents him having a machine gun. I'm pretty certain there are a lot of limitations.

If that kid is still alive, he must be growing tumors out his ass!

So anyways, back to the topic...so far nobody has pointed to a specific law that says posession of nuclear weapons is illegal in the US. However, I'm guessing that the posession of radioactive material requires a licence, so I guess Bill Gates would have to acquire a licence for that material before building a nuclear weapon, and if they didn't want to give him a permit then he couldn't build one legally.

Basically this kid wanted to get his eagle scout badge in boy scouts and he figured out a way to build a very crude breeder reactor, but he was really slack with his safety precautions and he filled the whole neighborhood with radiation for a few years until a chance encounter with some cops discovered all this stuff in the trunk of his car and they thought it was a bomb, eventually some environment agency was brought in to clean up the stuff and dispose of it.

American law is not just legislation. It's also court decisions. I'm absolutely sure it's illegal to possess fissionable material without some sort of license for starters. Without fissionable materials you can't build an A-bomb, much less an H-bomb.

Thats what I suspect as well.

I've never heard of any law that says it is illegal to posess nuclear weapons, however, you would need a licence to posess the materials needed to create it, and without the licence than you would be in posession of illegal material.

My partner lives in AZ and carries a loaded 45 with him. He was pulled over the other day for speeding and told the officer about the loaded weapon. Not only did they let him go for having the weapon, but did not even give him a speeding ticket. I guess it?s legal in some states.

Here you go Brisk... this should have most of what you are asking. The US doesn't have just *one* law that covers a lot of things that are illegal. Some have many and each covers some aspect of the particular subject. And as Unseen said, many 'laws' are merely court decisions which are handled as laws until they are overthrown or passed into law by Congress. (Look up 'obscene materials' - Federal Court Decision, not a lwa, but the same as since it sets precedence)

And many states have CCW(P) (or CCP's) permits. Carrying Concealed Weapon Permits... ALL of them state that you tell an officer that you are armed legally as soon as you are approached to insure safety. You might get away with not having your drivers license on you, but if you are carrying, you'd better HAVE that CCW permit or you are in deep doo doo.

I think nuclear materials are dealt with much the same as drugs... there may not be a specific law but there IS a list somewhere that has illegal to possess nuclear materials on it.

Sort of like:
One joint = the same amount of tar in *4* cigarettes
One nuclear bomb = 1 city or 500k people
