The District Attorney thinks he's guilty, they aren't presuming he's innocent. The judge and jury are the only people on this planet who are required to not have an opinion regarding his guilt or innocence.

The odds against Donny being the unfortunate victim in this sordid sick mess are astronomical. How many times has Donny sanctimoniously made a plea to the porn industry to understand that these poor girls who end up in the industry are 'someone's daughter'? Someone's daughter? Not just 'someone' in this case, it was the daughter of a close friend, being whored out for the father's perverted pleasure and Donny did absolutely nothing to get this girl help, not a single fuck given by a man who claims he walks with God.

I've been saying this again and again and it feels like it just falls on deaf ears. He is mentally ill. Not because he is "religious". Religion, he realized was just a great vehicle to manipulate and exploit others. Who better to take advantage of than people who want to believe what you are saying, but that also are much more likely to forgive another s transgressions? Who better to manipulate than a group of people that are being told day in and day out that we are all bad, that we do bad, but that we need to find the good in people, see the good in people and that no matter what, we should learn to forgive etc etc etc. You get free pass for all the little slips you make...for all the seemingly obvious contradictions and for all the little inconsistencies as you have an audience that wants to believe everything you are saying as its consistent with their values. This is all a psychopaths wet dream.

An interesting thing to me... forgetting about his many mental issues driving his behaviors... when it comes to sexual predators, its usually no different than any other type of predator. No different than any psychopathic criminal, like a mafia figure or serious gang banger or drug dealer or con artist or whatever. They sniff out vulnerable people like a lion does a limping gazelle. They can identify weakness as if its a sixth sense and do so with amazing accuracy. Their judgement is not clouded by normal emotional processing that causes us to look at someone who is completely insane and likely dangerous and say "oh, he's just a little eccentric" or "yeah, but he still loves me".

I was thinking about that when he gave his interview. To me, the story he gave in the first interview was kinda normal if the facts are somewhat true - a sick guy and sexual predator sniffed out a similar person and invited him to molest his own child. A sad part to this "story" if its anywhere near the truth, was that at the center, there was a young girl who was expected to perform the sex acts. If that was truly the case, then there is little to zero chance that she hadn't already been serially abused sexually, prior to this event. So, I think its a safe bet that a LOT of other damning stuff against the adults in the room, will come out of the investigations and interviews and it will just keep coming out. I just thought it a bit interesting because his story, to me incriminated him to a degree, in my mind and I think the prosecutor is going to have a very easy time with this. No matter how you look at it, he went on television and put himself at the scene of several crimes and made it clear that he there because he was expected to have sex with a child. Doing this sort of thing and speaking at all actually or without an attorney is something only a truly mentally impaired person would do. His need as a serial manipulator to keep manipulating with an attempt to correct others image of him so that he does not lose his perceived sense of control, far outweighs any other. Namely, that he should keep quiet, only speak through an attorney etc.

Also, i do appreciate that people like MaDalton or Far-l or CDsmith and others are cautious. I'm not. A court will determine guilt, but I just see what i've always seen, a very dangerous person (a manipulative predator - not necessarily violent) who has exhibited every trait of a very dangerous person with absolutely no conscience whatsoever and he's been this right in front of everyone, from his first appearance online.

Donny Pauling Jr. appeared in court on Friday to be arraigned on two cases of unlawful sex with a minor.

The hearing was continued because Pauling had not been able to gather the funds to retain private defense attorney Roberto Marquez, who has been appearing as Pauling's representative, as he did Friday.

Pauling is scheduled to return to court April 10.

If he can't afford an attorney he will be appointed a public defender. Like Candyflip said, most of them have a huge caseload and they don't have the time or resources for a long, drawn out trial.

A public defender will likely look at the evidence and then encourage Donny to let them try to cut him a deal.

Of course, Donny could always opt to represent himself which would not go well.

You can't help someone who has an overinflated sense of self and at the same time, thinks you're an idiot. It's likely that he will try to defend himself... at a minimum, it's highly likely that he believes himself fully capable of doing so.

He will of course have a court appointed attorney, but that is only a small step above Donny representing himself in court. The attorney he had wasn't too great to begin with; He was a local attorney who normally handled traffic tickets, DUIs, and dog bites.

Former Sutter County Jail Commander Lewis McElfresh has yet to enter a plea to criminal charges of child molestation three months after his arrest.

McElfresh appeared on Friday as a shackled defendant in Sutter County Superior Court Friday for the fifth time. Defense attorney Jesse Santana again was granted a continuation of the arraignment. The District Attorney's Office had objected, citing concerns the move was a delay tactic.

An arraignment is a hearing wherein a defendant is informed of criminal charges by a judge, is given a copy of the charging document and enters a plea.

"Case law says if you enter a plea, you're saying you're OK with that prosecutor," Santana said. "I don't want them to even think that."

Santana argued in a motion for the disqualification of the entire Sutter County District Attorney's Office from prosecution, alleging the DA's Office is not exercising its discretionary function in an even-handed manner. He said prosecutors have refused to file criminal charges against their lead witness, Chase Hammonds, who was allegedly caught burglarizing McElfresh's home Dec. 18.

District Attorney Amanda Hopper said Friday she has not received a report about that inc dent and the investigation is ongoing. She is aware of the burglary allegation, she said.
"I have already indicated my office will not be making a filing decision on that burglary, nor will we prosecute, because there could be a possible conflict of interest," Hopper said. "(Prosecution) will be handled by another agency."

McElfresh is accused of masturbating while, allegedly, watching a minor being sexually violated by Donny Pauling, who is also charged in the incident. Hammonds confronted McElfresh about the incident, recorded the conversation and provided the recording to a Sutter County sheriff's lieutenant, according to an officer's declaration.

A hearing for the motion to disqualify the DA, as well as the arraignment date, were rescheduled for April 22 by visiting Judge Dennis J. Buckley. If the DA's office is disqualified, the state Attorney General's Office would take McElfresh's case.

All Sutter County Superior Court judges have either recused themselves or have been disqualified by request of Santana or District Attorney Amanda Hopper.

Buckley did hear some arguments Friday.

The District Attorney's Office issued a subpoena to obtain the medical records of the juvenile whom McElfresh allegedly victimized. Santana filed a motion to stop those records from being released.

Buckley ruled the records will be included as evidence, as the juvenile has signed a release of the information, but any private information about McElfresh will be redacted.
McElfresh was arrested by the Yuba City Police Department on Dec. 16 while he was at work at the Sutter County Jail.

This just gets stranger and stranger....
