New Canadian Antispam Law Hits Violating Companies With $10M Fines




OTTAWA ? A new antispam law went into effect on Tuesday in Canada requiring email senders to verify that they have the recipient?s consent.

Regulators note that the rules apply to senders in the U.S. or anywhere else in the world who want to communicate with Canadians through email for any service or product ? not just sexually explicit material.

The Canadian Radio-Television and Telecommunications Commission said that consent can come in two ways ? implied or express. When it is implied, a company can assume consent if they have an existing documented relationship with the recipient.

With the new opt-in law, which will be phased in over three years, sending just one commercial email without permission could result in fines of up to $1 million (Canadian) for individuals and up to $10 million (Canadian) for companies.

After three years of implementation, the law will make it be possible for individuals and class-action groups to sue companies, organizations and directors for sending spam.

'Cuz everyone knows that spammers in Canada all have $1m laying around to pay the fine.

Funny how Canada (CRTC) implemented a 'Do Not Call' list in 2008 - then turned the list over to Bell to 'monitor'.

Bell, in turn...sold the list to off-shore telemarketers who were exempt from the 'Do Not Call' regulations.

No surprise - people who registered with the 'Do Not Call' list - began receiving MORE phone solicitations than ever before. Myself included. One of the worst was incessant calls from Bell themselves - even though I'm not even a Bell customer.

So this 'anti-spam' law should really do well, too.

How can Canadian law apply to people in the US? If every country makes such laws it will be impossible to follow...

It will be easier when they centralize the fine and debit process at New World HQ. They'll use crap laws like this and do not call and much more to justify it...for "administrative purposes."

All manner of companies, slimey or otherwise, are crawling out of the woodwork these past few weeks and one by one sending out their "request for consent" emails. It's almost hilarious really.

"PLease coNfirM thaT yOu WanT us to kEep senDing you our ShiT eMaiLzez"

Now you get to find out all the companies who bought lists that your name was on when you didn't want it on there. You may have purchased something five or ten years ago and the company you did biz with sold your email along with thousands of others. It's probably happened dozens of times over to all of us.

You wonder why you get so much spam crap and wonder how all these idiot companies keep getting your email address(es)? This is how. Canada is doing something about it... maybe. If they run it as effectively as that "do not call" list then it won't mean a hill of ant shit to anyone.

The USPS, is "required" to deliver all that shit...of course they are getting paid to do so, but I wish there was an "I don't want your junk mail", or an"unsubscribe" button for THAT shit...
It's way more annoying that spam emails.
