Manwin Mindgeek Gets A Taste Of Their Own Medicine and File Suit

Details on this one are thin because the Court system in Canada doesn?t make info as publicly available as most of the courts here. but here?s what I have:

A few of Manwin/MindGeek employees got their mailing list.

At least one of these employees was a former employee of Gamma Entertainment (also based in Montreal)

Gamma has allegedly been emailing people from this list for over a year

Manwin/MindGeek caught wind of it and has filed in court to injunct Gamma

Mindgeek/Manwin is now suing the former employees and have retained outside council for this purpose (Remember they fired the in house council back in March)

Manwin is now worried about people on that email list suing over privacy concerns.

I will keep you posted on what develops with this but there are whispers that this may be a case of corporate espionage, an email list of MindGeeks customers would be valuable indeed. There is a certain karma to it?.Sucks to have you hard work stolen doesn?t it Feras Antoon? David Tassillo?

If memory serves, it was a couple of million. The guys was openly shopping it all over the place. As for Gamma being involved/mailing it, that does not surprise me. They supposedly have a large in-house mailing team. I am not sure how much they will be able to tag out of Gamma's arse unless they have a smoking gun of some sort. I doubt that the ex-employee is going to be worth much in any sort of lawsuit.

I haven't done any email in a long time but would Gamma then be spamming if they were just mailing the list since it wasn't theirs? No optin or customer relationship to fall back on right? They must know the ins and outs as they have been around forever.

That would depend on Canadian law. The U.S. CAN-SPAM act really only governs those based here.

However, Gamma mails for a lot of companies to my understanding, fancying themselves as an ESP of sorts although they are doing the mailing for other porn programs. Which would be different from a traditional ESP role in that regard.

Anyway, either way it's most likely going to come down to what knowledge Gamma had, and can be proven. Most likely it will run the same as everything else. A lot of sabre rattling in the trades, and then quietly goes away for a few pennies.

One thing I am pretty confident of is that it was a HUGE breach

The suit was filed in the Ontario Superior Court of Justice, Commercial List and the plaintifs include MindGeek, Froytal, Cygest Trading and Webexpansion Cpyprus.

All manwin companies...some of which even I didnt know about...

So I'm guessing it was a mailing list that crossed companies within Manwin
