some clips4sale questions

Few questions about clips4sale.com for people who work for the company or sell content there:

1) What rights does clips4sale have over your content after you upload?

I found this in their terms (http://clips4sale.com/do/agree):

"3.2.5. By uploading media content ("Your Content"), You agree to give Us irrevocable nonexclusive royalty-free rights to use Your Content for any purpose, including publication, display, modification, and creation of derivative works. Your further agree that your will not license or permit use of Your Content to or by third parties seeking to create, or currently operating a substitute, or similar service or website as that offered by Us now or in the future. You further agree that, notwithstanding Your removal of Your Content from Our Site, You grant Our Users the irrevocable and nonexclusive royalty-free right to continue to view and use Your Content. We have the right to license any of Your Content up until the time You remove the file from the Website. Once submitted to Us, You may not remove Your Content from the Site until after Your Content has been posted for ninety (90) days, regardless of whether You choose to terminate Your Master Account. To be clear, once content is uploaded to Us, You must allow Us the opportunity to license Your Content for at least ninety (90) days."

That says you give them "royalty-free" rights, however they pay you a royalty. Also says you can not upload to another site similar to theirs. Then it says they can re-sell ("license") your content up until the time you remove the content or 90 days.

From this I take that the content is yours and you can do whatever with it except upload to another clip-site, until you take it off clips4sale when you can then do whatever you want and they no longer have any rights over it (past 90 days).

Then at the bottom of the site in the footer I see this:

"All materials published on the site (including, but not limited to news articles, photographs images, illustrations, audio clips and video clips collectively, 'content') are protected by Copyright (C), Trademark and all other applicable intellectual property laws, and are owned and controlled by Clips4Sale, Videos4Sale, Images4Sale or the party credited as the provider of such content, software or other materials."

This is saying that they "own" the content?

I would basically just like clarification on how the rights work after you upload.

2) Is there an affiliate program where affiliates can drive traffic to your store for a commission on your videos? It doesn't appear that there is which seems like something big that is missing, why?

3) When someone purchases videos from your store, do you as the "studio" collect any of the customer info such as name or email? Are you able to export this data for your own followup marketing?

I think the 90 day thing is because the person who buys the clip can download it for up to 90 days so if you removed all your clips those people would all be screwed and cause a bunch of charge backs.

They use to give you the customers name and e-mail and you could e-mail them when you had new stuff or anything for that matter but people abused it and now you just get K.L from San Fran bought your clip with no e-mail
