Canada: Supreme Court strikes down prostitution laws

A sweeping decision by the Supreme Court of Canada that struck down all of the long-standing Criminal Code provisions dealing with prostitution will not protect society?s most vulnerable, says a local advocate of sex-trade workers.



?I am saddened by this ruling as now the street-level sex trade becomes more dangerous and invisible,? said Deb Nanson, founder of the Sex Trade Task Force of Niagara and program director with Terry?s Evergreen Addiction Recovery Services. ?Street-level women are the most vulnerable.?

In a unanimous decision on Friday, the Supreme Court found that the bans on brothels, communicating for the purposes of prostitution and living off its avails violate the Charter of Rights and Freedoms because they endanger prostitute?s lives.

While the ruling might appear to offer protection to prostitutes, Nanson said, what is written in law books and what is reality are two different things.

?What type of brothel would hire (street-level prostitutes) when the Playboy-type is available,? she said.

?I love the women I work with yet my heart is in fear of how invisible they shall become. They do not have the same protection as others will have.?

In the judgment, Chief Justice Beverley McLachlin wrote, ?It makes no difference that the conduct of pimps and johns is the immediate source of the harms suffered by prostitutes. The impugned laws deprive people engaged in risky, but legal, activity of the means to protect themselves against those risks.?

The ruling is suspended for a year, giving Parliament time to rewrite Canada?s prostitution laws.

?It will be for Parliament, should it choose to do so, to devise a new approach,? wrote McLachlin. ?How prostitution is regulated is a matter of great public concern, and few countries leave it unregulated.?

Justice Minister Peter MacKay said the government is reviewing the decision and ?exploring all possible options to ensure the criminal law continues to address the significant harms that flow from prostitution to communities, those engaged in prostitution, and vulnerable persons.?

Niagara Regional Police Const. Derek Watson on Friday said the service would not be commenting on the landmark ruling at this time.

?We respect the court?s decision and are in the process of reviewing the ruling,? he said,

Glen Walker, executive director of AIDs Niagara, was encouraged by the decision.

?We will be looking towards the upcoming months to see what it may mean to the lives of sex-trade workers in Niagara.?

The decision hands a victory to a team of three women, including Terri Jean Bedford who has said she wants to open a brothel that specializes in painful or humiliating sexual encounters.

They challenged the prostitution laws, arguing that hookers are safest when they can hire security guards and work indoors.

They say it'll be about a year or so before they officially adjust the criminal code with the new changes. Remains to be seen how the cops will deal with it between now and then.

To my understanding (someone correct me if I'm wrong), fucking hookers was already legal - the illegality was 'communicating for the purposes of...' - a bullshit technicality that still made it somewhat illegal (for the johns) to approach a hooker.

What we need, in Canada AND America, are legal, affordable brothels with monthly testing and very strict work schedules for the workers. Simple.

my point is if we change laws to prevent those breaking them from being hurt, there are a lot more people who put themselves in harms way other than prostitutes.

this law just made pimps everywhere into businessmen. if this is to go forward it should extremely highly regulated as most people who run such "businesses" view the women as property or goods, not people. this will be a huge boom to the human trafficking industry as well.

It's called 'worker safety' man. If a woman wants to fuck fifty guys a day, 30 days a month straight, she is putting herself (and others) at risk, let alone devaluing "the product". LOL

In Germany it's one week on, three weeks off I think. And the sex worker must be tested monthly. They must shower before and after each client, etc etc etc. Besides, as the John, would you want to fuck some slaggy, stretched-out cum dumpster ho? Maybe you would, I dunno. LOL

Not trying to start a fight here and I'm certainly not grasping at straws or trying to make a ridiculous point. This is EXACTLY what copyright laws are in place to prevent. How you can even attempt to argue that is beyond me.

That being said, Yes, I absolutely believe 100% that you posting the entire article here directly effects the income of the copyright holder. I believe this because I own websites where I post articles like this. I rely on the traffic to those sites to generate income. There is no way that you, as a person who works with the online community, can be blind to the fact that traffic = profit. By taking away from that traffic, you are costing them money. Putting a link up doesn't mean jack because we have no reason to click the link since we've already read the article.

Post the first sentence or two or paraphrase the article and post a link...That's fine and would be appreciated by those who own the content. Copying and re-distributing it is illegal and damaging.
