Wells Fargo et. al. sold off the mortgage to Fannie Mae or Freddie Mac. Unless ALL of the holders of interest in the MBS sue they can't come to court. See Landmark Nat?l Bank v. Kesler, 2009 Kan. LEXIS 834 (Aug 28, 2009)--- Only the real party in interest can come to court.

I know I give you a lot of grief on GFY, but your aunt does have a case here. I have yet to see a mortgage company not violate the National Mortgage Settlement Agreement. Post something here and I'll get back with you. I have several people i the same boat. More suits help all.

Seriously, this problem with the house, banks seem to say "GFY" if your one minute late. As I said there is help. If you're coming to KC, I'll buy you lunch to discuss your family's house.
I know this sounds like smoke, but hey at worst you get a free lunch and the possibility of saving the house.

WellsFargo did not buy the loan from Wachovia. In 2008, Wells Fargo & Company acquired Wachovia Corporation.

Wachovia and Wells Fargo are one and the same and have been for several years now. You would have received a bunch of letters about this transition back when it happened.
