			Yesterday I moved to Silicon Valley into a cheapie apartment and everyting is fine, but it seems there is a woman above me and her 6 year old-or something son who is constantly pounding on the floor, screaming, and crying. 
		
	
		
		
		
		
		
	
	Stomp Stomp Stomp. Right now as I type this I think he is jumping off the sofa and on to the floor. I mean it is constant, there isnt a 30 minute break. I work from home, this is killing me, I cant concentrate. Any suggestions for anything to cancel out the noise? Im stuck here for 12 months and cant get out of it, so I need a way to deal with this noise. A white noise machine? some headphones? Im going to get some ear plugs now and see if that helps. annoyed because the whole building is quiet, except the people right above me trapped for 12 months  |

Instead of freaking out on a porn webmaster board & looking for a lawyer after a few hours, why not take the common sense approach - go upstairs and talk to her about it, explain you work from home etc, if she's at all a decent person she'll try to limit her kid jumping around. 		 The apartments were cheaply built. Amoung other things the flooring in the apartment above was very likely just nailed down and not glued and screwed down. Very common problem with cheap construction and nothing you can do about it. 		 Apartments in California are all build with wood structure which really allows for noise to pass thru the walls and really amplify it. This construction material is used as the areas are subject to earthquakes. Some noise proofing is needed to keep the noise out BUT most apartment buildings do not do much of this! 		 Been decades since I've lived in an apartment, but as I recall there should be a clause in your rental agreement that stipulates that tenants must not make excessive noise which is irritating to others (assuming you're not a crackpot who expects absolute silence living in a downstairs apartment).

		 Not sure about California but in just about every place you are entitled to peaceful enjoyment. I would tell the landlord you are unable to work because of the noise and to let you out of the lease (or put you in another unit) or you will sue for moving expenses, etc. 
		
	
		
		
		
		
		
	
	Soundproofing is out of the question because of the expense and it is almost next to impossible to soundproof that kind of noise because it radiates through the studs and into your walls. If the landlord is resistant then start recording the noise for proof, break the lease and move, fuck that shit.  |

		 Based on my experience unless you find some headphones or a way to cancel out the noise you are fucked. I have lived in a few apartment complexes with noisy neighbors and it never goes well. 		 I feel your pain, I had some similar situation not so long time ago... I'm afraid the only possible solution is to move out and to find something in peaceful area preferably with reliable agency/landlord and preferably on a last floor or with thick beams.
