    Who's ever filed a trademark?

    Better to go with someone like LegalZoom or hire an attorney?

    Seems like this is something you can do yourself, anyone ever tried?

    Never registered a trademark, but filed many copyrights myself directly on the US Government website. Might be the same process?

      I have done Trademarks but its a pain. The initial online form is not bad but they almost always come back weeks later with what the call an "Office Action". That is where they don't want you in a certain category, or they want an example of the font used, blah, blah, blah...

      The next time around I just left it to www.breanlaw.com

        Our company uses a trademark attorney.

        Trademarks for us need to be filed world-wide (USA and Madrid at a minimum) and with different jurisdictions.

        The trademarking of a name can be challenged on common law usage and by similar trademarks holders in other jurisdictions.

        I would not compare trademark filing to copyright filing. Copyrights are easy in comparison and cheap to file.

            I was about to jump in this thread to say I received some tm bs today on a domain I purchased and had no clue it related to any company ever and there it is - xlove. I will sell you guys the domain as I purchased it in bulk as a *CAM* domain.

                  I filed one a couple of months ago. In our case the use of a good patent attorney versed in the field of our patent made the encompassing description we are claiming well worth his fees. ($3,250)

                        I am not interested in that, pay me cost of the reg and I will pass on the domain...

                              Plenty of decent attorneys will file one on your behalf for $500 (or less) + filing costs. Office Actions can suck though. Just TM "meaningful" marks that have value by being exclusive to your product and service. Too many idiots pay for TM registrations that they abandon or never use (must have continuous use to maintain TM registration).

                              U.S. registrations on principal register can be quite valuable, as they allow you to get statutory damages against infringers and initiate UDRP actions against cyber-squatters...

                                  I have 3-4 trademarks. It was a pain in the ass. Go with a lawyer who specializes in trademarks, not just a regular attorney. Attorneys have a knack at not turning down work they have no expertise in & it will just cost you more money in the end

                                        All depends where you live and what you are trademarking too seems on the web USA trademark is only way to go as rest can mean diddly squat. If you trademark something in some countries it is only good for that country. Always hear in Australia how someone had to close down or sued due to their business name or generic names trademarked overseas.

                                            Everybody always wants something for free. Attorneys are great at playing hardball.

                                            In the end though attorneys cost a lot of money. So if you can contact the actual owner of the domain and not his attorney you can often get them to buy the domain at a reasonable price that is less than it will cost the attorney to legally wrangle it from you many months to years later.

                                              The other nice thing about an attorney is that they give you great information and the low down on how people most often lose the rights to their marks. You can look it all up on your own, but maybe you could have also made more money doing actual work and leaving the attorney shit to the attorney.
